We call on the UK Government to introduce a statutory framework—“Gio’s Law”—to ensure proportionate oversight and welfare safeguards for individuals under prolonged pre-charge investigation.

Currently, individuals can remain under investigation for extended periods without charge, often subject to restrictive conditions such as pre-charge bail or electronic monitoring. These conditions can significantly impact mental health, employment, and private life, even in cases that ultimately result in no further action.

We believe there should be:

Automatic judicial review of pre-charge bail and electronic monitoring
Statutory time limits, with extensions approved only by a court
Access to mental health support during prolonged investigations
Accountability where cases conclude with no further action after extended restriction

This proposal would not weaken protections for complainants. Instead, it would strengthen fairness, proportionality, and welfare within the justice system, ensuring that all individuals are treated humanely while investigations proceed.

We urge the Government to consider legislative reform or pilot safeguards to address this gap in the justice process.
