Stop Trump’s Ban On Flag-Burning Free Speech
The Issue
On August 25, President Donald Trump signed an executive order making it a criminal offense to burn the American flag in protest. Within hours, Jay Carey — a 22-year Army combat veteran and Bronze Star recipient — was detained outside the White House for doing just that. His message was simple: the First Amendment guarantees freedom of speech, and no president can erase that right.
Flag-burning may be controversial, but for decades the Supreme Court has upheld it as protected speech. In 1989 and again in 1990, justices ruled that even offensive or unpopular expression is still expression — and the government cannot decide which opinions are legal. Trump’s new order directly defies this precedent, threatening to criminalize political dissent and silence Americans who speak out against the government.
If a president can jail people for burning a flag, what’s next? Arrests for criticizing him in the streets? Punishment for holding up protest signs?
