STOP The New Criminal Laws

The Issue

This petition by People of India is about the upcoming 3 new criminal laws of India which are supposed to be enforced from the 1st of July.

Through this petition we wish to highlight the grave potential threat to human rights of 140 crore Indians and thereby potential human rights violations against them through various clauses of these laws and to seek the intervention of the National Human Rights Commission to put an immediate hold on them. 

Constitutional experts, human rights advocates, Sr. Advocates have expressed over months that the new laws passed and proposed to be implemented are far more draconian than the colonial era laws. Some of the legal luminaries who have spoken up include Sr Advocates Indira Jai Singh, Kapil Sibal, Vrinda Grover, Prashant Bhushan, Abhishek Manu Singhvi, Mukul Rohtagi, Colin Gonsalves, IAS, IPS officers and many others.

The way these laws were passed is also a huge question mark on democratic operations and legal sanctity of the laws. 150 MP's were expelled and there wasnt proper and required threadbare debate or discussion about the laws and we the citizens of India were left bereft of information about harmful contents and clauses in laws being passed to enslave us and the country once again, all in the name of transforming the legal system of the country.

These laws are not only a violation of various sections of the Constitution of India, can be used for vendettas, silencing critics, rational voices, upright Public Servants and can be used against citizens in innumerable ways and thus turn into an issue of mass human rights violations. 

Clauses in these laws can lead to every household suffering in various ways. 

Citizens of the country can suffer irreparable loss, harm & injury which may not be fulfilled in any terms, ever. 

In short, these laws can spell the death knell to our democracy and can turn India into a Police state.

To elucidate, 1/7th of the total human population of the world can be subject to human rights violations. 

This gross and severe infringement on human rights can undermine the ability of citizens to act, live and operate freely and will threaten our rights to exercise democratic rights freely and without fear of reprisal. This can ultimately lead to deprivation of life across the country.

It will also lead to further exodus from the country, affect foreign investment and wreck a financial and economic havoc on the nation and it's polity.

Those very public servants who were entrusted to ensure justice, law and order, had not only the duty as per mandates of jobs to serve India and its citizens, keep it safe, but had also taken an oath to do so in  the largest democracy in the world by bringing these draconian criminal laws which are criminal in themselves are attempting to further damage and hijack the world's largest democracy. 

We the Citizens of India urge and impress upon the National Human Rights Commission to immediately take necessary steps as per powers vested in the Commission and ensure no harm is done to citizens or the nation and our democracy by acting swiftly and putting a stay on these laws till every single harmful clause has been removed or laws dismissed all together. 

Further, we request NHRC to join any and all cases already filed or being filed in various courts as per powers given to the commission in the PHRA 2021.
