

Stop the Indiana Bill Mandating School and Workplace Cooperation with ICE
The Issue
Indiana deserves laws that keep our communities safe while upholding our shared values of fairness, opportunity, and local control. Senate Bill 76 does not do that.
SB 76 would punish schools, colleges, and local governments if their employees are seen as not fully cooperating with federal immigration enforcement. By banning even “unwritten” policies that limit how staff handle immigration status information, this bill risks turning teachers, professors, and public servants into de facto immigration agents. That is not the role Hoosiers expect from educators or healthcare workers whose primary duty is to serve students, patients, and families.
Parents want their children to feel safe at school. Students cannot learn if they are afraid that a routine interaction could put their family at risk. Educators should be focused on education—not immigration enforcement.
SB 76 would also empower the Attorney General to sue employers and potentially suspend or revoke business licenses if there is “probable cause” to believe undocumented workers were knowingly hired. Even some lawmakers have warned this could harm Indiana’s economy. With tens of thousands of open jobs across the state, our industries rely on a stable workforce. Policies that create fear and uncertainty for businesses and young people raised and educated in Indiana will hurt local communities—not strengthen them.
Hoosiers across the political spectrum agree that serious crimes should be addressed and that federal immigration law must be clear and consistent. But this bill goes beyond that. It entangles local schools and governments in controversial federal enforcement actions and risks damaging trust between communities and public institutions.
We call on Governor Braun and members of the Indiana State Senate to reject SB 76 in its current form and work toward solutions that protect public safety, safeguard students, respect local leadership, and strengthen Indiana’s economy. Indiana can uphold the law without undermining the very communities that make our state strong.
