In 2006, Noe Moreno was arrested and wrongfully accused of being the drunk driver in a car accident where one person died and others were injured. Despite evidence that he was not the driver, his criminal defense attorney failed to conduct any investigation and persuaded Noe to plead guilty. The lawyer told Noe the evidence against him was overwhelming and that he would only get a 'few' years if he pled. The judge sentenced Noe to 18-22 years. Noe maintained his innocence throughout. After the Duke Wrongful Convictions Clinic stepped in and conducted a thorough investigation, a North Carolina judge (with the District Attorney's consent) vacated Noe's convictions.

Instead of letting Noe go home to his elderly mother, who has end stage kidney failure, ICE continues to press for his deportation -- despite the fact that his mother would certainly never see him again. Noe spent almost seven years in prison for a crime he didn't commit, and his mother spent almost seven precious years without her son and companion. Now ICE wants to separate them forever and is fighting to deport him.
