N.Y. Thoroughbred Breeder arrested: 6 animals dead- 32 animals saved

44,900 Supporters of " STOP the Animal Neglect in Columbia County, New York" want to know when Paul Czajka, District Attorney, County of Columbia, N.Y. and James Carlucci, ADA are going to file criminal charges and prosecute Andrea Nussinow, owner/operator of Blue Star Thoroughbred Breeding Farm ( BS Farm ) for 35 criminal acts of Animal Cruelty ?
Between 2014-2019 the Public continued to do their civic duty by filing Animal Cruelty complaints against Nussinow with the Police and Columbia Greene Humane Society.
Columbia Greene Humane Society: there were no public records found reflecting any enforcement of the NYAGM laws against Animal Cruelty at Blue Star Thoroughbred Breeding Farm initiated by CGHS. No written warnings, tickets, arrests, or re-arrests despite evidence of dead and dying animals.
New York State Police arrested Nussinow 7/4/17 and 3/17/20 for Animal Cruelty. The New York State Police "must" enforce the NYS laws, and so far, it appears the NYSP is the only agency in Columbia County that has tried to protect the suffering animals at BS Farm as required by law.
Paul Czajka, DA claims to have a conviction rate of over 90%, but for some reason, Czajka and his staff seem "afraid to prosecute" Nussinow, a New York Thoroughbred Breeder for multiple and repetitive Animal Cruelty violations since 2014.
Now it is up to Paul Czajka, District Attorney of Columbia County, N.Y. to fully prosecute this case to protect the animals as required by Federal and State laws prohibiting animal cruelty, and to safeguard the community. Research as shown intentional cruelty to animals is strongly correlated with other crimes, including violence against people.
44,900 Supporters of "STOP the Animal Neglect in Columbia County, N.Y." would like to ask Columbia Greene Humane Society, and the County of Columbia Officials when they plan on interviewing and deposing dozens of witnesses, experts, and requesting discovery documents to defend the County and CGHS against Nussinow's "bogus" 15 million dollar lawsuit claiming false arrest in 2017, or is the plan to lose by design with the intent to participate in Insurance Fraud against the Government and the Taxpayers ?
Does Columbia Greene Humane Society plan on "rolling" over for Nussinow by intentionally losing the case (lawsuit) to enrich Nussinow after years of not enforcing the NYAGM laws against Animal Cruelty, not making any arrest, and participating in the Grand Jury Hearing 12/17 which conveniently led to Nussinow not being indicted, and the basis of Nussinow's "bogus" false arrest lawsuit ? CGHS didn't even bother to file a Motion to Dismiss the case. To our knowledge, over the past 19 months, the County and CGHS have only deposed Nussinow, Ron Perez, President of CGHS, Lee DeLisle, Chief Animal Cruelty investigator, and possibly Paul Czajka, District Attorney even though a trial date for Nussinow's Federal false arrest complaint is scheduled for June 2021 ! It appears the County and CGHS has a lot of work to do if they have any intention on defending themselves against false claims made by Nussinow, and recovering all the legal fees and expenses paid for by the Taxpayers.
How many complaints did CGHS receive between 12/17 and 12/19 regarding the ongoing animal cruelty violations at BS Farm?
Did CGHS enforce any NYAGM laws against Animal Cruelty at BS Farm to reduce the suffering of the animals and enforce the law?
Did CGHS help save the 38 suffering animals the New York State Police "seized" on 1/2/20? The answer to this question is NO.
The New York State Police had to request the assistance of Godspeed, an outside non-profit Animal Welfare Agency to do what should have been done years ago to protect the suffering and dying animals.
Did CGHS make any donations, or provide any financial assistance to Godspeed to help care for the 32 surviving animals for the past ten ( 10) months as the "lead Animal Cruelty Investigative Agency" in Columbia County, accepting donations for the Prevention of Animal Cruelty from the Public ? We think the answer to that question is no as well.
Evidence, witnesses, expert opinions, and official complaints are on record with multiple State Agencies re: the Animal Cruelty that continued for 2 more years from the day the prosecution, assisted by CGHS failed to indict Nussinow, until 1/2/20, the day the New York State Police "seized" 38 animals due to their severe neglect and emaciated condition.
Does anybody see any problems with the lack of enforcement of Animal Cruelty laws at a Thoroughbred Breeding Farm, the failure of the District Attorney's Office to prosecute this Animal Cruelty case at a Thoroughbred Breeding Farm, and the "creation" of a "false arrest" foundation for Nussinow after a "botched Grand Jury Hearing" 12/17 resulting in a No true bill ?
The prosecution controls a Grand Jury Hearing, and the evidence, witnesses, and experts presented for the prosecution and defense, so how did the prosecution “approve” Nussinow to present 3 character witnesses, 2 Veterinarians, and her own testimony absent of expert testimony by licensed Veterinarians, testimony of numerous credible witnesses, and volumes of evidence for the prosecution to obtain an indictment ?
Another obvious problem with the Grand Jury Hearing is the ADA dismissed 7 out of 11 animal cruelty charges, and it appears they failed to advise the Grand Jury that the prosecution dismissed "all" Thoroughbred horses and other horses privately owned by Nussinow, and a Thoroughbred boarder so the "rescue defense" could survive. Adding insult to injury, the prosecution omitted the expert opinions and testimony that the "rescues" Nussinow based her entire defense on were neglected and starved in her custody before & after being arrested 7/4/17, and before the Grand Jury Hearing...so obviously it appears this important evidence for the prosecution omitted by the ADA should have been provided to the Grand Jury to review to reach a True Bill Vote.
Recently, the FBI announced the indictments of 27 Thoroughbred trainers, Veterinarians and others that participated in a “ Racehorse Doping Scheme” described as animal abuse, which led to hundreds of racehorses breaking down on the track, and risking the lives of the jockeys. The FBI made it clear that abusing the racehorses and cheating the system will not be tolerated.
In December 2017, the prosecution explicitly stated after they failed to indict Nussinow that there was not enough evidence to proceed. In our opinion, that statement was categorically false. The correct statement should have been the prosecution failed to present enough evidence for the Grand Jury to indict Nussinow, a Thoroughbred Breeder. The No True Bill appears it was reached by “either” the defendant providing “false statements” under oath without immunity to mislead the Grand Jurors, or perhaps there was a concerted effort to exonerate Nussinow by tampering with the evidence, switching the horses, obstructing justice, misleading a Grand Jury with the intent to commit insurance fraud for millions of dollars at the expense of the Government, Taxpayers, and the suffering of the Animals.
Nussinow has expressed interest in a Change of Venue for the criminal charges after being arrested by the NYSP on 3/17/20 for 35 Animal Cruelty charges claiming conflicts of interest. That may be the only thing the People agree with. If Paul Czajka, DA, his staff are “ afraid” or “unwilling” to prosecute this case, and there are perceived conflicts of interest present, perhaps in the interest of justice, a Change of Venue to proceed with the prosecution should be granted without delay.
