SUMMARY OF BILL AS AMENDED (003058): Creates a Class A misdemeanor offense for a person to engage in adult cabaret entertainment on public property or in a location where the adult cabaret entertainment could be viewed by a person who is not an adult. Establishes that a second or subsequent such offense is a Class E felony. Effective April 1, 2023.
FISCAL IMPACT OF BILL AS AMENDED: NOT SIGNIFICANT
Assumptions for the bill as amended:
• The proposed legislation defines adult cabaret entertainment as adult-oriented performances that are harmful to minors (persons who have not reached 18 years of age and are not emancipated), and that feature go-go dancers, exotic dancers, strippers, male or female impersonators, or similar entertainers and includes a single performance or multiple performances by an entertainer.
• There will not be a sufficient change in the number of prosecutions for state or local government to experience any significant change in revenue or expenditures.
• Any impact to the court system as a result of the proposed legislation is estimated to be not significant.
