

PUBLIC STATEMENT FROM THE EXECUTIVE DIRECTOR
Tonight, I am speaking directly to the residents of 89704, 89521, and 89511, and to the media outlets covering our community.
You may have noticed my physical absence at the meeting tonight. I was not absent; I was working. While the Board was debating, I was on my computer filing critical documents in our federal case—including an Injunction and a Temporary Restraining Order (TRO) backed by a mountain of evidence and exhibits.
I watched every minute of that meeting. I studied the process, I listened to the arguments, and I realized something vital: Tonight’s proceedings just gave us more evidence to work with.
I anticipated a moment like this. For months, I have been quietly building a Safety Net through this lawsuit to protect our community when local politics fail us.
What this Safety Net means for you:
The Lis Pendens: I have filed a Lis Pendens, which clouds the title of the property. No developer can ignore the fact that this land is tied up in federal litigation.
The Case is Alive: Despite what you heard tonight, the Judge did not agree with the magistrate's recommendation to dismiss.
Court-Authorized Access: The Judge has granted me a PACER account, recognizing this as an active, ongoing federal proceeding.
Expanding Action: I have filed eight additional documents since that recommendation, added a new defendant, and the deadline for them to object to my filings has already passed.
A Call to Action:
The independence of the Federal Judiciary is stronger than a local board vote. I am not waiting on the Marshals to move this forward. I am asking the community to step forward now as volunteer process servers. We must act ourselves so we aren't held up by bureaucracy.
Underestimate me if you want, but while you were voting, I was filing. We are just getting started.
