THE TRUTH: The DA Is Misleading You – Our Federal Fight Is Stronger Than Ever

I need to set the record straight about yesterday’s 3-2 vote by the Board of County Commissioners. It was clear from the District Attorney’s statements that he has not read our 42-page Federal filing or any of the evidence we’ve submitted since.

Here is the reality the County is trying to hide:

The DA is Gaslighting You: Yesterday, the DA focused on an old suggestion from a Magistrate Judge. He failed to tell you that the District Judge overseeing the case did NOT agree with the Magistrate.

A Major Court Victory: I filed a formal objection to the Magistrate’s suggestion, and the Judge accepted it. In a huge move last week, the Judge signed off on a motion granting us PACER electronic filing access. In federal court, this is a massive "green flag"—it means the court recognizes the competence of our strategy and is treating this as a serious, viable case.

Emergency Injunction is ACTIVE: Yesterday afternoon, I filed an Emergency Injunction to stop this project in its tracks. That injunction has NOT been denied. I am filing a formal notice to the Judge today regarding yesterday’s 3-2 vote to ensure the court knows exactly how the County is trying to bypass public safety.

The Lis Pendens Stands: Our lis pendens (notice of pending litigation) remains a "cloud on the title." They cannot easily sell lots or get clear title insurance while we are fighting in Federal Court.

Flying to Vegas for the "Giant Killers": I am currently flying to Las Vegas to finalize meetings with powerhouse class-action attorneys who have won billions of dollars in cases regarding toxic land and water rights.

I am doing this for YOU.

I have put in over 500 hours of my own time, at no pay, because this is a testament of patience and a love for our valley that has endured.

A Personal Note:

I want my neighbors to know that this isn't about ego for me. This isn't about me trying to be a "hero." This is simply about doing what is right, ethical, and legal. If I wanted the glory for this work, I would be taking media interviews every day—but I haven't. I work better quietly in the background. I may be a top 10 country music artist, but I am also an introvert, and my focus is 100% on the legal work required to protect our homes.
