The Issue

Imagine being sentenced to 91 years in prison for a crime you didn't commit, while the real perpetrator walks free. This is not just a nightmare but a reality for someone I know personally. Delaware’s judicial processes must uphold justice and fairness, but the introduction of Senate Bill 179 threatens to do the opposite.

Senate Bill 179 proposes to repeal and recodify the Delaware Sentencing Accountability Commission, yet fails to enhance or even maintain the essential appellate review mechanism that was previously established. Under the former regulation, 11 Del. C. § 6581(g), individuals had a lifeline; a way to contest and review potentially unfair sentences. Without this critical review process, hundreds of individuals in Delaware face the risk of unjust and excessive sentencing, with no formal path to appeal and correct the system's wrongs.

The alarmingly high number of over-sentenced individuals in Delaware underscores the need for robust oversight and the ability to seek justice through appeals. According to criminal justice reports, systemic issues in sentencing disparities disproportionately affect marginalized communities. By not preserving the appellate mechanism, SB 179 neglects the broader implications for these communities and the principle of justice for all.

The proposed bill shifts focus towards the structural aspects of the Commission—its membership, duties, and reporting requirements—while ignoring crucial aspects of justice delivery. A fair judicial system should not prioritize bureaucratic restructuring over individuals’ fundamental rights to seek justice and correct miscarriages of justice once they occur.

In Delaware, the stakes are too high to allow SB 179 to pass in its current form. We need mechanisms that provide hope and a chance for redemption, not barriers that leave individuals, especially those wrongfully sentenced, with diminished paths to justice.

We call on the policymakers of Delaware to reconsider this bill, prioritize the preservation and strengthening of the appellate review process, and ensure it is equipped to address and rectify the injustices within our criminal justice system. Let us not strip away one of the last lifelines for those wrongfully sentenced by an imperfect system.
