SB 164, now advancing in the Florida Senate, would allow anyone who impregnates another person—including abusers and estranged partners—to sue over a miscarriage or abortion, at any stage of development.
This bill isn’t about justice. It’s about control.
SB 164 creates a dangerous legal weapon that could be used to punish women and anyone who helps them get the care they need. Under this bill, doctors, hospitals, and even friends or rideshare drivers could be sued—sometimes years after the fact. By treating fertilized eggs as people under the law, the bill expands Florida’s Wrongful Death Act in ways that undermine both science and established medical practice.
This isn’t just theory—it’s already happening. In Texas and Arizona, similar laws have been weaponized by abusive exes to target women’s support networks. If SB 164 passes, Florida will be next.
What’s more, this bill would deepen our state’s existing maternal healthcare crisis. It discourages OB-GYNs from practicing in Florida, puts hospitals at risk for providing emergency care, and burdens an already-strained system with costly legal threats. Rural and low-income communities, which already face longer wait times and fewer providers, will be hit hardest.
