The issue
I recently purchased entries into a house giveaway promoted by RS Rewards on social media, featuring influencer Tammy Hembrow. As a Sydney resident, I was excited at the prospect of winning a house, until I discovered a crucial piece of information hidden deep within the terms and conditions: residents of New South Wales (NSW), like myself, are excluded from winning. This significant exclusion was not disclosed anywhere in the advertisements, on the checkout page, or during the purchase process.
This is deeply problematic and misleading for several reasons. Firstly, RS Rewards is specifically targeting NSW residents by running paid advertisements that reach thousands of people in this region. Secondly, the purchasing process shows active entries in our accounts, creating a false sense of participation and hope.
According to the Attorney General's Department of NSW, transparency in advertising, especially in promotions and giveaways, is legally required to prevent consumer deception. The Australian Competition and Consumer Commission (ACCC) enforces these regulations to protect consumers from unfair practices.
The lack of transparency not only breaches consumer protection laws but also exploits the trust and excitement of people like me who participate, hoping for a fair chance to win. Despite having spent money on entries, we stand no chance of winning due to undisclosed restrictions.
