Stop Retaliation Against Domestic Violence Victims

The Issue

Having personally experienced domestic violence in the State of Florida, particularly in the cases of the State of Florida vs Damian McGowan and the State of Florida vs Cindy Alexander, I have witnessed first-hand the retaliation that victims and witnesses endure. This retaliation discourages individuals from coming forward and seeking justice, perpetuating a cycle of abuse.

  Women, the primary victims of domestic violence, live in fear as abusers continue their reign of terror. We are often coerced, intimidated, and bullied by our abusers and or the abuser's family to withdraw charges, perpetuating the cycle of abuse and rendering victims invisible in the eyes of the very system meant to protect them. This ongoing travesty must end, and victim safety and justice must become non-negotiable priorities.

 To address this critical issue, we propose stronger laws and penalties for domestic violence offenders that effectively deter repeat offenses and facilitate justice for victims. First, eliminate plea bargains and lesser charges for domestic violence cases to ensure that offenders face the full gravity of their actions. Establish a national registry for domestic battery that keeps track of offenders, much like sex offender registries, making it easier for law enforcement and the community to recognize repeat offenders. This could assist these predators for crossing the state border where their history may not be of public knowledge.

 Furthermore, extend the hold times for those arrested on domestic battery charges, allowing for comprehensive assessments of the victim's safety and the perpetrator's risk of reoffending. Immediate intervention programs should be mandatory for all cases to provide victims with support, protection, and resources to safeguard their lives and regain control. Domestic violence victims need assurance from our legal system that their well-being is paramount.

It's imperative to recognize that instead of receiving protection, victims and witnesses often face intimidation, harassment, and even threats after reporting domestic violence incidents. These actions are not just threats to individual safety but are a direct affront to justice and the heart of human dignity.

According to the National Coalition Against Domestic Violence (NCADV), around 29% of women and 10% of men in Florida experience some form of intimate partner violence. When victims and witnesses face retaliation, these numbers are exacerbated, as fear silences many who would otherwise come forward, seeking justice and support.

Local authorities and lawmakers need to enhance laws and guidelines to ensure the protection of victims and witnesses. Implementing clear and robust anti-retaliation guidelines, coupled with sufficient resources for enforcement, is essential. Accessible legal support and assured anonymity for victims can significantly uphold justice while encouraging more individuals to testify against their abusers without fear.

Concrete measures could include mandatory training for law enforcement on handling retaliation cases, establishing a dedicated task force to oversee domestic violence cases in Florida, especially in areas of high crime throughout the state of Florida, and ensuring there are safe reporting channels that guarantee confidentiality.

 Protecting those brave enough to stand up against their abusers is paramount, not just for their safety, but for curbing the widespread issue of domestic violence in our communities. With community and governmental support, we can foster an environment where victims and witnesses feel safe and empowered.
