Stop Proposed Zoning Amendment - Strata Lot 72, Strata Plan KAS 3690

The Issue

Whereby, the Owner Developer of Strata Lot 72, Strata Plan KAS 3690 has applied to the Town of Osoyoos to amend Zoning Bylaw 1395 2024 to rezone the subject property from CT2 to CT2s to permit the replacement of the common owner amenities, including but not limited to the Owner Lounge / Club House, or portions thereof with 5 motel units.

And where, the addition of 5 motel units within the confines of the Strata Corporation, will unreasonably interfere with the Owners rights to peaceful and quite enjoyment of their Strata Lot, impose financial burdens and or hardships on the Owners of the remaining 71 Strata Lots by way of increasing operating costs to all owners, for owner specific use items such as increased water and other utility consumption  and garbage disposal, and may affect other operating costs such as insurance and off season services.

And where, the current visitor parking stalls considered common property of the Strata Corporation, have been included and used in the Owner Developers application to satisfy the off-street parking required for motel use.  Under the Town of Osoyoos zoning bylaws, motel's must provide a minimum of 1 off-street parking stall for each dwelling unit, and under the Strata Property Act, the Strata Corporation must provide a minimum of 1 visitor parking stall for every 10 Strata Lots as well as 1 designated parking stall for each strata lot.  On this basis, with the addition of 5 motel units, the Owner Developer would be required to have 6 designated parking stalls (1 for the strata lot owners / caretakers unit, plus 1 for each of the 5 motel units) and the Strata Corporation is required to have a minimum of 7 visitor parking stalls, putting the total required parking stalls for the redevelopment at 13.  At current, there are only 10 common parking stalls within the boundaries of the Strata Corporation property.

And where the Strata Property Act, and Registered Strata Bylaws contain a number of provisions which prevent commercial use, and require Strata Permission for any and all alterations, and where such permission has not been requested from the Owner Developer of Strata Lot 72, prior to
