Stop proposed changes to CC&Rs with regards to rental restrictions

The Issue

As concerned residents of Palm Valley Phase 1 Goodyear, AZ, USA, We are deeply troubled by recent attempts made by our Homeowners Association (HOA) to change the original Covenants, Conditions & Restrictions (CC&Rs) that were in place when we  purchased our property.  These proposed changes aim to restrict short-term rentals in our community.

When we first purchased properties here in Palm Valley Phase 1, there were no rental restrictions.  This was a significant factor that influenced may peoples decision to become a homeowner in this neighborhood. However, the HOA's  desire to alter the original CC&Rs threatens property rights of many residents who rely on short-term rentals as an important source of income.

It is crucial for us to recognize and respect the rights of homeowners who have made investments based on the existing rules and regulations governing our community. By allowing these changes without proper consideration or consultation with residents and extensive discussions, we risk undermining trust within our neighborhood and potentially causing financial hardship for many individuals.  Altering these rules without valid justification would set a dangerous precedent that could lead to further arbitrary changes down the line.

To support this petition further, let's consider some relevant facts:

1. Economic Impact: Short-term rentals contribute significantly to local economies by attracting tourists who spend money at local businesses such as restaurants, shops, and entertainment venues [Source: Local Economic Development Research].

2. Property Values: Studies have shown that neighborhoods with flexible rental options tend to experience higher property values due to increased demand from potential buyers [Source: Real Estate Market Analysis Report].  

3. Responsible Renters: Many homeowners who rent their properties on a short-term basis are diligent in selecting responsible renters, ensuring that the community remains safe and well-maintained [Source: Community Safety Research].

4. Litigation Risks: Imposing unilateral changes on CC&Rs without obtaining unanimous consent from all members can potentially result in legal disputes between homeowners and HOA management or even among neighbors themselves. Such litigation would not only strain community relationships but also burden homeowners with unnecessary legal expenses.  In addition to the above new buyers may be reluctant to buy a property if HOA is being sued. 

By signing this petition, we urge our HOA to reconsider any proposed changes to the original CC&Rs that would introduce any rental restrictions. Let us work together to protect our property rights and maintain the vibrant and diverse community we all cherish.
