Stop Noise Pollution In Our Residential Estates

The Issue

The Darul Arqam Islamic Center along Nyando Road in Kileleshwa has been polluting our peaceful environment with unbearable levels of noise beginning this January. The noise emanating from the public address system mounted on the rooftop is unbearable. Although we respect the right to religion as enshrined in the constitution we are alive to the fact that laws regulating noise apply to religious institutions including mosques. 

Efforts to reach an amicable solution with the management have bore no fruit including intervention by the area MCA who has engaged the mosque on one occasion on behalf of the area residents. Despite our pleas to lower the noise levels the noise pollution brazenly still persists. We would like your aid on escalating this matter to have the mosque get formal communication from the National Environment Management Authority (NEMA) and the Nairobi County Government. The Nairobi City Public Nuisance Act 2021 clearly states that residents have a right to a quiet environment regardless of the nature of businesses around. The Environmental Management & Coordination Act (EMCA) noise regulation provides for prohibition of sound producing and sound amplifying equipment that are loud and annoying or offensive in a manner that interferes with the comfort, repose, health or safety of the members of the public. 

The Petition therefore demands that;

1. The National Environment Management Authority (NEMA) to enforce regulations touching on noise pollution in this particular case.
2. The National Environment Management Authority (NEMA) enforces the noise pollution mitigating aspects contained in the Environmental Impact Assessment (EIA) report presented by the mosque before construction.
3. To seek clarification from the Nairobi County Government, bearing in mind the Nairobi City Public Nuisance Act 2021, and the National Environment Management Authority (NEMA) on how the mosque got approval to operate in a pre-existing residential area bearing in mind the noise pollution threat that comes with such an institution including inconveniencing area residents by blocking gates with cars on Fridays.
