Kikao Place Club located at Kamiti Road borders Kamiti Ridge Estate of Kiambu County which is home to hundreds of residents. As much as we support businesses within the confines of our laws, the music that blares from Kikao Place Club is noise pollution. Children as well as adults cannot sleep due to the excessively loud music played throughout the night till 5:00 am. Learners cannot concentrate on homework due to the noise. Residents have reached out to the management at Kikao Place Club to address the issue but they have remained adamant and insensitive to the plight of the residents. 

In this regard, we hereby submit this petition to have Kikao Place Club adhere to noise regulation laws or in the alternative is closed immediately or relocated. There is precedence in law to support the right to a peaceful environment. The Nairobi City Public Nuisance Act 2021 clearly states that residents have a right to a quiet environment regardless of the nature of businesses around. 

Article 42 (a) of the Kenyan Constitution states: “Every person has the right to a clean and healthy environment, which includes the right to have the environment protected for the benefit of present and future generations through legislative and other measures.”

The EMCA noise regulation provides for prohibition of sound producing and sound amplifying equipment that are loud and annoying or offensive in a manner that interferes with the comfort, repose, health or safety of the members of the public. 

The Petition therefore demands that;

1. The National Environment Management Authority (NEMA) to enforce regulations touching on noise pollution in regards to Kikao Place Club vis-a-vis residents of Kamiti Ridge Estate.
2. The National Environment Management Authority (NEMA) enforces the noise pollution mitigating aspects contained in the Environmental Impact Assessment (EIA) report presented by Kikao Place Club.
3. To seek clarification from the Kiambu County Government and the National Environment Management Authority (NEMA) on how Kikao Place Club got approval to operate in a pre-existing residential area bearing in mind the noise pollution threat that comes with such an institution including inconveniencing area residents.
