

STOP IRRATIONAL EXIT PRACTICES BY TRUCKING COMPANIES
The Issue
For far too long company drivers have been treated unfairly in the trucking industry by trucking companies operating inside the gray area of the FMCSA drug/alcohol testing policies/guidelines. Trucking companies are given broad authority when it comes to company drivers and how they're implementing the random drug testing procedures. The FMCSA has been allowing truck companies to go unchecked. With unreasonable and irrational demands. There is indeed a strong understanding by company drivers on how and why a random drug test would be important to the trucking industry when implemented the correct way! Company drivers also desire the need to be safe when operating heavy machinery. However no company driver who submits a (2) weeks verbal/written notice should ever be subjected to a random drug/alcohol test. It's not founded in logic nor is it a reasonable request of that company driver. What is the purpose of having drivers submit to a drug/alcohol test after he/she has given a verbal/written (2) weeks resignation? FMCSA is very clear on who should be tested! Many drivers have suffered in unimaginable ways due to trucking companies using the drug testing policy by the FMCSA as a way to retaliate and blackball company drivers who feel they're well within their right to refuse testing. Let me be very clear. This petition is no way intended for drivers who were pulled for a random drug test and then decided to quit the company! There has to be some kind of checks and balances when it comes to what a trucking company can legally do to a company driver upon his/her exit from the company. Requiring a driver to take a drug test after knowing the driver will no longer be a part of the company is a complete abuse of power and authority! These types of practices mirror that of a post-employment drug test. which is listed nowhere in the FMCSA drug/alcohol policy guidelines. Drivers are tested before hire (rightfully so) and are also able to be tested during their employment with a company. It's not about having something to hide. It's more so about having rights as an individual. Our truck drivers are the backbone of America and should be treated with respect and dignity!
