

Stop insurance discrimination against drivers for not-at-fault accidents
The Issue
I have been denied jobs because of not-at-fault accidents on my motor vehicle record, and this affects my chances to be with my wife and kids while remaining in the trucking industry. It's a problem not just for CDL holders but for anyone whose job involves driving. Take, for instance, a mechanical failure that caused me to wreck after a complete and passable pre-trip inspection. Everything checked out. Or consider when a lady failed to merge correctly and hit me. In both scenarios, the accidents were deemed by law enforcement as NOT AT FAULT on my part. Yet, I am being denied employment by every company I apply to.
This is a widespread issue that affects countless drivers. Many people are losing out on job opportunities due to not-at-fault accidents being flagged negatively on their records. This unjust practice does not reflect the realities of driving or the responsibilities involved. The Federal Motor Carrier Safety Administration (FMCSA) indicates in their studies that truck drivers are only at fault in major accidents 16% of the time, while car drivers are at fault up to a substantially higher percentage.
When applying for jobs, drivers are judged based on their motor vehicle records. However, it's unfair and prejudicial to hold not-at-fault accidents against us. These accidents, which are unavoidable and beyond our control, should not result in job denials. Drivers deserve fair evaluation based on actual fault and circumstances, not just numbers on paper.
I urge insurance companies and potential employers to redefine their criteria and stop penalizing drivers for incidents where they are not at fault. By doing so, employers won't miss out on hiring qualified, responsible drivers, and insurance companies can maintain fair practices that reflect the reality on the road.
