In general : If you want to forward a legal "Eigenbedarfskündigung" ( right to use a rented room for you / yours) you have to explain it very detailed : the person ,reason ,why you did not offer the room only for restricted period, because you could have forseen the need . Furthermore, you have the duty tooffer a similar room to the person who should leave the falt/ room and / or offer some damages (moving costs ,reparation more expenses, badly placed new flat , etc.) .IF there is no real reason and /or only willful false arguments (court )you have to pay reparation to the person even if/ she/he already moved (difference of rent up to 3 years) .Friendly reminder were send again and again to the landlord/ advocates , new alternatives offered ( see15. Nov.2013) , no peace , justice ? Hopefully , the prosecutors will work more precisely and will be finished very soon. !
