I am writing this petition because I have personally witnessed the unjust treatment of a Georgia National Guard soldier. She has dutifully served our state and country for years, dedicating herself to protecting our freedoms. Yet, she now faces an unfair disciplinary process that threatens to end her military career, strip away her retirement benefits, and eliminate her future opportunities - all without granting her a fair chance to defend herself.

This soldier alleges a series of retaliations after she bravely reported misconduct and filed complaints. Her story is not unique. Under current Georgia Military Code, updated in 2018, National Guard members are being systematically denied their constitutional rights. They are not offered a hearing, representation, or any form of recourse when facing disciplinary actions, including termination. This is a direct violation of due process rights as guaranteed by the U.S. Constitution.

The National Guard members are citizens just like us; they live in our communities, yet they are deployed worldwide to protect our freedoms. How can we, as a society, allow them to be denied these basic rights at home?

We are calling upon the Georgia Legislature to amend the Georgia Military Code to align with constitutional due process protections. This change will ensure that Citizen Soldiers are entitled to a fair hearing, access to legal representation, and appropriate avenues for appeal when facing disciplinary actions.

This is not simply a legal issue; it is a moral imperative. We must stand up for those who risk everything for our freedom and ensure they receive fair treatment.
