Stop Executive Order 5240- End Forced Institutionalization & Criminalization of Poverty

The Issue

We demand the repeal of Executive Order 5240 and an end to the federal assault on civil rights, public health, and local self-governance.

We, the undersigned, call for the immediate repeal of Executive Order 5240, “Ending Crime and Disorder on America’s Streets,” issued on July 24, 2025.

This executive order does not solve the root causes of homelessness, addiction, or mental illness — it criminalizes them. It reintroduces the failed logic of mass incarceration and forced institutionalization, targeting vulnerable people instead of offering compassionate, evidence-based solutions.

Specifically, EO 5240:

Encourages forced commitment of unhoused people with mental illness or substance use issues — often without due process or consent.

Punishes cities and states that use harm-reduction or housing-first approaches by withholding federal funds, coercing local policy through fear.

Authorizes health data-sharing with law enforcement, threatening the privacy rights of disabled and medically vulnerable individuals.

Rolls back key protections under the ADA, Olmstead v. L.C., and other landmark decisions protecting civil liberties.


We believe:

Homelessness is not a crime.

Addiction is a health issue, not a moral failing.

Mental illness deserves care, not confinement.

Cities and states must be allowed to govern in the best interest of their residents — not under federal threat.


We stand with disability rights groups, harm reduction advocates, housing justice coalitions, and local leaders who are resisting this unconstitutional overreach.

We demand:

1. The full repeal of Executive Order 5240.


2. An immediate halt to all federal enforcement efforts under this order.


3. Congressional investigation into the human rights and civil liberties implications of EO 5240.


4. Funding for real solutions: housing, healthcare, mental health treatment, and harm reduction — not surveillance and punishment.
