Stop Emil Bove from Being Confirmed as a Justice to the Third Circuit Court of Appeals
The Issue
We are a diverse group of United States citizens who wish to voice our opposition to the nomination by this administration of Emil Bove III to a lifetime position to the Third Circuit Court of Appeals, one step away from the Supreme Court. While we don’t agree on everything, we are resolute in our view that Mr. Bove is unqualified to serve in this position and that his nomination is a travesty to the cause of justice in these troubled times.
We will not use this platform to cast aspersions on Mr. Bove’s past service as an Assistant United States Attorney in the Southern District of New York (“SDNY”). With respect to his background, we instead would refer to the article by Benjamin Weiser of the New York Times, which we attach.
Instead, we focus on what Mr. Bove has done since his elevation in this administration to Principal Associate Deputy Attorney General, a position that does not require Congressional approval. Since then, Mr. Bove has been the driving force behind the shutdown of the investigation and prosecution of Eric Adams on corruption charges brought by the SDNY, which is widely believed to be a quid pro quo for Adams’s cooperation in immigration enforcement by this administration. Mr. Bove has also been closely involved in the deportation of hundreds of immigrants to a gulag-like facility in El Salvador, without affording them the due process rights to which they are entitled. These deportations were in direct violation of federal court orders, which were ignored by Mr. Bove and his underlings.
Mr. Bove is clearly unqualified under any standard to serve on the federal bench. We urge Congress to reject his nomination.
