Stop Discriminatory Car Requirements in Non-Driving Job Ads in New Zealand
The issue
We call on the New Zealand Government to address and eliminate discriminatory employment practices that require applicants to own a car for roles that do not inherently demand driving.
Recently, I experienced a seizure that has resulted in me not legally being able to drive. This personal experience underscores how arbitrary car ownership requirements in job advertisements—especially in fields like fashion and retail where driving is not a core job duty—unfairly exclude individuals with valid medical conditions. These discriminatory practices ignore our professional skills and creativity, placing undue burdens on those of us who are prevented from driving due to circumstances beyond our control. I am trying my hardest to get employed in a competitive market, and finding or obtaining employment is already challenging; this unnecessary requirement only adds more hurdles. I have never had a car before, and I cannot learn to drive now due to my recent seizure.
Many positions in sectors such as fashion, retail, and creative industries have recently imposed unnecessary car ownership requirements. These practices are not only illogical but also discriminatory. They exclude capable individuals who:
- Suffer from medical conditions like epilepsy, which can temporarily or permanently prevent driving.
- Have intellectual disabilities or other conditions that affect their ability to drive, yet do not hinder their professional skills.
- Cannot drive due to past driving offences or convictions.
- Choose not to drive due to financial constraints, personal priorities, or phobias and trauma related to driving.
We believe that job advertisements should focus on skills, creativity, and professional talent rather than irrelevant requirements such as car ownership when the role does not involve driving. These car requirements serve as an unjust barrier, reducing opportunities for many talented New Zealanders and undermining the principles of fairness and equal opportunity under the Human Rights Act 1993.
We urge the Government and policymakers to:
- Review current employment practices and guidelines related to job requirements.
- Ensure that car ownership is only mandated when it is a genuine occupational qualification.
- Promote hiring practices that focus on relevant skills and talent rather than unnecessary personal criteria.
Our country thrives on creativity and talent. Let’s remove the outdated barriers that prevent many capable individuals from contributing fully to our industries.
