Stop child sex offenders walking free due to lack of evidence.

The Issue

A child was sexually assaulted when she was aged two, the police recognised that this did happen and admitted they know it happened but due to her age and having no witnesses or forensic evidence (there is a 24/48hr window), they said they would not be able to prosecute him or take it to court. There was a lot of evidence surrounding the case and the probability was very high surrounding the circumstances.

Due to lack of formal evidence needed such as witnesses or the child to be able to testify in court the offender wasn’t even questioned or no one checked his phone for evidence. I find this very alarming, how many children under 5 are been abused behind closed doors, who is going to sexually assault a child with a witness present!

After this he was allowed to apply for contact at the family court (civil). Also reassured by police that there was enough evidence for the civil court and he would not be granted contact. However, after years of mental trauma he was granted access to supervised contact via video.

This was mentally traumatic and feels wrong in so many ways. Paid thousands in solicitor fees until could no longer afford, not entitled to legal aid. The courts continued to advise I needed a solicitor, however I could not afford after already spending savings to protect a child from a sex offender. Whilst the offender has legal aid using public funds.

The government must recognise what is happening to children under 5 in the UK, why is this allowed. Changes have to be made to protect our children and innocent people. Please with gratitude sign this petition and maybe we will be recognised. I doubt this will help this case but it may well help many others.

The offender still walks the streets today, has access to children and is a danger for further offending.

The majority of child abuse cases remain hidden and therefore do not enter the criminal justice system.

Around 227,500 identifiable child abuse offences were recorded by the police in the year ending March 2019, of which around 1 in 25 (4%) resulted in a charge or summons.

The number of suspects the police had referred to the Crown Prosecution Service (CPS) for a charging decision fell by 22% in the last year; the charging rate for legal decisions1 also fell (from 73% to 68%).

Please be the childrens voice, let us be heard and get justice.
