The Issue
Fourteen years ago, I served time in prison. Since then, I've turned my life around completely. I have stayed out of trouble, raised a family, and actively participated in community activities, making positive contributions wherever possible. Despite my efforts and the new path I have chosen, I find myself entangled in a system that holds my past against me in employment settings, thanks to Checkr, Inc.
Checkr, Inc. provides background reports to companies and is not bound by the limitations imposed by many states on how far back employers can look for criminal history. This unlimited reach allows them to go back 20, 30, or even 40 years to report old convictions, which disproportionately affects those of us who have worked hard to rehabilitate and reenter society as law-abiding citizens. This unrestricted reporting makes it impossible for people like me to secure employment with companies that rely on Checkr’s reports, such as DoorDash, Uber, and others.
There are laws in place in most states to protect individuals from such exhaustive scrutiny, limiting how far back employers can look into criminal records. However, Checkr's practices make a mockery of these protections, putting unnecessary barriers in front of us who seek to provide for our families and contribute to our communities. Many companies unknowingly participate in this unjust practice, resulting in wrongful deactivation from platforms where we have shown exemplary performance and received outstanding customer reviews.
It is essential for both companies and background check firms like Checkr to respect state laws and recognize the potential for individuals to change. Denying opportunities based on outdated information serves only to perpetuate cycles of poverty and disenfranchisement.
I urge Checkr to revise its practices and align with state laws that restrict the temporal scope of criminal background checks.
