Canadian Armed Forces

A new Canadian Armed Forces policy that bars military chaplains from offering faith-specific prayers at official events with mandatory personnel attendance is drawing a response from military faith advisers as well as calls in Ottawa for its reversal.

The policy includes events such as graduation parades and change-of-command ceremonies, ship commissionings, honours ceremonies, mess dinners, and Remembrance Day commemorations.

Canadian Charter of Rights and Freedoms

Section 2(a) - Freedom of religion

Freedom of religion has been defined as “the right to entertain such religious beliefs as a person chooses, the right to declare religious beliefs openly and without fear of hindrance or reprisal, and the right to manifest religious belief by worship and practise or by teaching and dissemination”

How the Charter Protects You

Applies to Government: Under Section 32, the Charter exclusively controls federal, provincial, and municipal government actions and laws—not private disputes. [1]
Guarantees Fairness: Sections 7 to 14 protect your legal rights, ensuring life, liberty, security of the person, and protection against arbitrary detention or cruel treatment. [1]
Equality and Freedoms: Section 2 covers fundamental freedoms (expression, religion, assembly), while Section 15 guarantees equal protection and benefit of the law without discrimination. [1, 2, 3, 4, 5]
Taking Legal Action Against Injustice

Section 24(1) Remedies: Allows anyone whose Charter rights have been infringed to apply to a court for an "appropriate and just" remedy, which can include financial damages or a formal order stopping wrongful state action. [1, 2]
Section 52(1) Invalidity: Empowers judges to declare any government law or statute that violates the Constitution to be of "no force or effect". [1]
Reasonable Limits (Section 1): The government can only limit your rights if they prove in court that the limit is demonstrably justified in a free and democratic society. [1]
