STOP Bill C-5 Conditional Sentencing for those convicted of Rape, Kidnapping, Human T
The Issue
Subsection 14(2) of Bill C-5 repealing sections 742.1(e) and 742.1(f) of the Criminal Code removed two limitations, the second of which removed the prohibition on conditional sentencing for a series of offences, including: kidnapping; sexual assault; and human trafficking.
At stake the courts MUST deny conditional sentencing for these offences. To allow this clause potentially endangers the safety of the community and revictimizes those affected by sexual assault. Ask yourself where is there justice when conditional sentencing allows someone convicted of sexual offences to maintain employment, live in a community and establish stability? At the same time, ask yourself, why should a rapist qualify for consideration when the woman he raped can experience an adverse life changing impact where she is unable to maintain emotional stability in her life and potentially could lose her job? This clause is without merit as it infringes on the right to live without the fear and emotional distress of knowing a convicted sex offender lives in our midst.
