Make Government-Owned Ally Financial (GMAC) Accountable to Taxpayers Under the Constitution
The Issue

Ally Financial has engaged in a campaign of foreclosure and other vile acts against the American taxpayers. Ally, formerly GMAC, received $17 billion in taxpayer bailout money resulting in over 70% federal government ownership. As a government owned corporation, Ally should have never been able to take people’s homes illegally and without the due process of the law guaranteed by the Constitution. FHA Fannie and Freddie are responsible to the public as government entities. Even if economic and human rights issues do not appeal to you, sign this petition if you care that a company that was a recipient of the biggest bailout has been allowed to use your money to finance its own agenda against the less fortunate.
In 2012, Ally's mortgage subsidiary filed bankruptcy, yet in 2012, Ally made $1.2 billion. Ally argued in bankruptcy court that it shouldn't have to pay its victims anything. In July 2013, Ally agreed to pay 232,000 consumers an average of $991 per victim for illegal foreclosures. No one should get away with illegally foreclosing on a family's $150,000 home, putting little babies on the street, ruining credit for 7 years and giving pocket change as a token settlement. In December 2013, after getting caught practicing discrimination against more than 235,000 auto loan consumers, Ally only had to pay an average of a $350 to each victim. The bullying hasn't stopped. Ally, thanks to the American taxpayer, can afford to pay lawyers $1,000 an hour to defend Ally's right to commit countless acts of injustice against the less powerful.
In the case, Lebron v. National Railroad Passenger Corp, 513 U.S. 374 (1992), the U.S. Supreme Court held that government owned corporations are an agency of the United States for the purpose of individual rights guaranteed against the government by the Constitution. This is also found in Title 5 of the U.S. Code (5 U.S.C. 103) and the Government Corporation Control Act ((GCCA) 31 U.S.C. 9101-10). Federal judges favor the big bully over the lone consumer and will almost always rule for the one with the most power. Sign this petition so as a collective group we can make Ally answer for its acts.
What could it mean if Ally is considered a federal government actor? It would have to comply with the Constitution just like any other government entity but it wouldn't get the benefit of immunity. It would no longer be economically beneficial for it to violate our rights. Ally has rebranded itself with a new name and advertising to make it appear as better than other banks. Do not be fooled. Ally Bank is like a white washed grave. It has been repackaged to look clean and new but inside it is still run by the same people that used fraud and robosigning of false affidavits to target hundreds of thousands of homes. Now Ally has scrambled to sell its government ownership in a likely effort to avoid any future accountability. You can be a factor in how this story ends for every taxpayer by signing this petition, sending it to everyone you know and refusing to bank with Ally Bank until Ally is made accountable for its past and continuing actions in a meaningful way.
