Dear Members of the Board,
We, the undersigned homeowners of Stonebrae, submit this letter as a formal petition and request for Board action, consistent with the Davis-Stirling Common Interest Development Act, the Stonebrae governing documents, and the Board’s fiduciary duties of care, loyalty, and good faith.
This petition is submitted in good faith, based on reported conduct and governance concerns, and is intended to request appropriate process, review, and transparency—not to assert findings of fact or personal liability.
1. Security Decisions – Request for Due Process, Transparency, and Homeowner Participation
We formally request that no new or expanded security measures, contracts, or expenditures be approved or implemented unless and until:
• A documented needs and risk assessment is conducted
• A written cost analysis (including initial costs, ongoing expenses, and impact on assessments and reserves) is provided to homeowners
• Homeowners are given reasonable notice and opportunity to review the proposal
• A homeowner vote is conducted where required by the governing documents or where the financial and lifestyle impact is material
Unilateral action on matters of this magnitude, without homeowner disclosure or participation, raises governance and fiduciary concerns under California HOA standards.
Good-Faith Statement
This petition is submitted:
• Without malice
• Without intent to defame or accuse
• For the limited purpose of ensuring proper governance, transparency, accountability, and compliance with California HOA law
Request for Acknowledgment
