The wrongful conviction of Gary Lane Prewitt:

On July 22 1994, two men broke into a home in rural Newberry county, S.C. A neighbor went to check on the house. As the neighbor entered the back door, someone in the house shot him, twice under the right eye and once in the chest with a 357 mag or a 38 special, then the suspects fled the crime scene in an old green Gm made car. The victim stated it was 2 white males one having black hair.

Three Days after the crime a 17 year old girl named Kimmie Shipes who lived about a mile from the crime scene told authorities that a white male having redish blonde hair was at her back door on the same morning of the crime. She helped with a composite drawing of the person. After further investigation authorities spoke with 2 suspects and known burglars with lengthy criminal records which let to Gary Lane Prewitt’s photo being put in a photo line up. Authorities showed the photo lineup to Kimmie Shipes and she identified Gary Lane Prewitt’s photo as the subject at her backdoor the day of the crime. Authorities took the photo lineup to the hospital where the victim was still being treated for the gunshot wounds and the victim identified Gary Lane Prewitt’s photo.

On August 10th 1994 authorities arrested Gary Lane Prewitt for the crime.

In January 1995, during a jury trial, the prosecution presented no physical evidence, no gun, no fingerprints, no DNA, the only evidence presented was Kimmie Shipes identification and the victim's identification of Gary Lane Prewitt. The victim that was shot has an intellectual Disability and was a 49 year old man that only went to the First Grade in school. Gary Lane Prewitt had 3 alibi witnesses. None of the stolen property was ever recovered, no car matching the description was ever found. No second suspect was questioned or arrested and Gary Lane Prewitt didn’t at the time nor has he ever given any type of confession.

Gary Lane Prewitt was found guilty of burglary-1st degree and assault and battery with intent to kill and sentenced to life in prison plus 20 years.

Two years after Gary Lane Prewitt’s conviction in April 1997, the same girl that testified against Gary Lane Prewitt , Kimmie Shipes-Heaton (now Married) and her husband were delivering newspapers and were shot. Mr. Heaton was shot in the temple and behind the right ear and Mrs Shipes-Heaton was shot in the chest. She told Authorities that 2 black guys and a white guy were the ones responsible. She also told Authorities she had received threatening letters weeks before the shooting from Gary Lane Prewitt seeking revenge for her testimony against him. Her husband died from his injuries and she was in the hospital for 6 days. After her release from the hospital authorities asked her to help with composite sketches of the 3 men she said killed her husband and shot her. Her story began to unravel as she could not produce the threatening letters she claimed Gary Lane Prewitt wrote to her. After a failed polygraph test Kimmie Shipes -Heaton confessed to shooting her husband and shooting herself in the chest. She later went on to plead guilty to the murder of her husband. She received a 50 year sentence.

In 2011, a private investigator, Pete Skidmore spoke with Kimmie Shipes-Heaton, she signed a statement that she lied about everything on Gary Lane Prewitt. She stated she was coerced into identifying him in the photo lineup by police. She also gave the investigator a medical report from a Doctor that evaluated her. Kimmie Shipes-Heaton had been in a mental hospital from 1991 until she dropped out of treatment in 1993. The Doctors evaluation report also states she had a long history of mental illnesses (hallucinations hearing voices, magical thinking and other mental issues )

In Gary Lane Prewitt’s case there is No DNA, no fingerprints, no Violent criminal history, no green car was every found, no stolen items were ever found, all eye witness testimonies were inconsistent, the composite sketch was of a 6ft tall red haired man, Gary Lane Prewitt is 5ft 6in with brown hair. He has spent 26 years in prison for a crime he had absolutely nothing to do with.

GARY LANE PREWITT IS 100% INNOCENT! He was convicted on the testimony of a man with a intellectual Disability and a woman that also has suffered from major mental illnesses. PLEASE SOMEONE HELP THIS INNOCENT MAN!
