The Issue
To Potomac Heights Mutual Home Owners Association principle office located at 200 Cedar Lane Indian Head MD 20640 Voluntary Terminate the Corporation of PHMHOA
We, the undersigned qualified shareholders and residents of Potomac Heights Mutual Homeowners Association (PHMHOA) consisting of Four Hundred Eighty Four (484) units, petition for the Termination of the Corporation known as PHMHOA. Voluntary Termination of PHMHOA is in accordance with the Maryland Condominium Act § 11-123 (a), the PHMHOA’s By-Laws Article XV, and pursuant of Maryland Code § 3-406 Articles of dissolution.
To Maryland Attorney General, Charles County Government, and Charles County Courts : Involuntary Terminate the Corporation of PHMHOA
We, the undersigned qualified shareholders and residents of Potomac Heights Mutual Homeowners Association (PHMHOA) consisting of Four Hundred Eighty Four (484) units, petition for the Termination of the Corporation known as PHMHOA. Involuntary termination of PHMHOA is in pursuant of Maryland Code §3-413: Cooperations and Associations subsection (b)(2) in which the acts of the directors or those in control of the corporation are illegal, oppressive, or fraudulent.
STATEMENT OF REASON FOR TERMINATION
We are citizens who believe that the privilege to maintain our own property should be assigned to us, as the property owners without the interference of the corrupt and inadequate management by Potomac Heights Mutual Home Owners Association, Inc.
This petition seeks to terminate the Co-op agreement of PHMHOA which currently prevents the members to own the land/home they live on/in, and with the termination, the members will then be defined as home owners with ownership of the Deed on their allotted land oppose to shareholders.
We request that the PHMHOA, Maryland Attorney General, Charles County Courts, and Charles County Government act quickly to terminate the Certificate of Incorporation of Potomac Heights Mutual Home Owners Association, Inc. In accordance with the Maryland Department of Assessment and Taxation Charter Division’s Article of Dissolution, we are requesting that each unit owner receive a separate Deed for the billing property address which their dwelling is located as also defined in Charles County real property taxation, and receive the town of Indian Head as resident agent.
