PETITION FOR CRIMINAL PROSECUTION OF BETSY RODRIGUEZ

FOR HITTING AND KILLING MIQUEAS “MIKEY” PEREZ-RAMOS

We, the residents of Southwest Florida, are petitioning for the following actions:

●       We demand a full and thorough investigation of this case by either the State Attorney’s Office, or if a conflict of interest exists between Amira Fox’s office then an independent prosecutor to handle the matter.

●       We demand that with the evidence the State already has they have enough evidence to file formal charge(s) against Betsy Rodriguez, and we demand that those charges formally be filed now.

●       We demand justice for Mikey and his family, which means the person responsible being held accountable in the courts through trial or plea once formally charged.

 

On February 13, 2021, 18-year-old high school senior Miqueas “Mikey” Perez-Ramos went for his typical morning run. It was during this morning run that he was struck by an SUV and was left to die in a ditch by a 55-year-old driver. The driver of the vehicle who hit and killed Mikey was owned and operated by Betsy Rodriguez. In fact, the Florida Highway Patrol investigated this incident and Mikey’s gruesome death. The FHP investigation uncovered evidence which demonstrated that Ms. Rodriguez was driving the vehicle that hit and killed Mikey, that Ms. Rodriguez hit Mikey, that her vehicle had damage to the front end of the vehicle consistent with the injuries sustained by Mikey, and matched debris on the vehicle to the scene of the hit and run. In fact, Ms. Rodriguez went back to the scene of the incident in a different vehicle with an unknown man, just hours after it occurred, but fled the scene when Mikey’s mom showed up to the area by locating and tracking down his cell phone. At the time of the deadly collision, Mikey’s body was flung into a sign causing property damage, and his body ended up in a ditch on the side of the subject intersection, where he slowly died from his injuries.

 

Mikey had a bright future ahead of him, but this was all tragically cut short by Ms. Rodriguez’s actions. Mikey did not deserve to die in such a cold and brutal way – nobody does. Mikey was the kind of person that made everyone laugh and smile. He loved to entertain those around him and would do whatever he could to make you smile on a bad day. This passion to help people in difficult times led to him becoming very popular in social media. Mikey was only three months away from graduating high school. It was Mikey’s dream to become a barber and work his way through college so that he could help children with cancer. Mikey’s little brother is a cancer survivor and Mikey’s life calling was to help other children who had to fight cancer like his little brother did. Mikey had a heart of gold and he was poised to make the world a better place one person at a time. Mikey worked passionately to reach his goals, but he had no idea that the actions of one cowardly person would extinguish his bright flame forever. Tragically, Mikey never crossed that high school graduation stage, and he will never be able to accomplish his selfless goal of helping children who are battling cancer. Mikey never got to reach his potential because he was killed by Betsy Rodriguez on February 13, 2021 in a deadly hit and run collision while out for a run. Mikey’s death is a tragedy that has left many family, friends, and loved ones heart-broken and searching for answers – the main answer sought by this broken family is justice! Justice for Mikey and the criminal prosecution and conviction of the woman who hit him with her car, fled the scene, and then came back to the scene after it happened.

 

The one thing Ms. Rodriguez could have done immediately after she hit Mikey with her car was call 911 – this could have saved Mikey’s life! She could have done this at the scene the first time, she could have called when she got back to her house, and she could have called when she went back to the scene a second time in another vehicle with that unknown man, but she didn’t. Instead of making the lifesaving call to 911, Ms. Rodriguez let Mikey bleed to death in the ditch that her car flung him into that morning. The evidence obtained by FHP during the investigation of this tragedy confirms all the facts contained within this Petition. When FHP closed the investigation and handed off the case to the State Attorney’s Office for prosecution, it seemed like Justice for Mikey was just an Information away from happening. Oddly, with all the information contained within the investigation done by FHP the State Attorney’s Office headed by Amira D. Fox decided not to file criminal charges against Betsy Rodriguez. We the people of Southwest Florida now ask… where is the justice for Mikey? We demand that Justice be done. The first duty of society is justice, and that starts with a thorough investigation, the filing of criminal charges, and a conviction of Betsy Rodriguez for killing Miqueas Perez-Ramos.

 

It has now been a little over a year and despite the continued efforts of our family, the SWFL community, and our attorney Casey Gartland of the Pendas Law Firm, the State of Attorney’s office had not filed any criminal charges against Ms. Rodriguez for hitting and killing Mikey. Mr. Gartland has been relentless in his pursuit of justice for Mikey. He has spoken with the State Attorney’s Office numerous times, exchanged emails with them, and even appeared on several news media programs to try to get Amira Fox and the State Attorney’s Office to do the right thing and file formal charges against Ms. Rodriguez. While mourning his loss, Mikey’s family has been fighting for justice, but despite all of our collective best efforts, nothing has been done and the family has only received the runaround by the State Attorney’s Office – but no charges for Betsy Rodriguez. Law enforcement gathered an abundance of evidence, but even with this evidence the State Attorney’s Office still refuses to complete the investigation and file formal charges. What is stopping this process? Is it because Mikey is Hispanic? Is it because Ms. Rodriguez knows someone in the State Attorney’s office? Is it selective Prosecution? Is this sort of failure to act contrary to the oath of office Ms. Fox took when she became State Attorney? Whatever the reason, we the people of southwest Florida demand Justice for Miqueas Perez-Ramos. We want Ms. Betsy Rodriguez formally charged for what she did and convicted, anything less is a miscarriage of justice.

 

If the state continues to deny an investigation, then they are sending the wrong message to all of Southwest Florida’s residents. This sort of prosecutorial blunder sets a dangerous precedent, that if you are involved in a hit and run that results in someone’s death there will be no consequences. The only option now that would allow Amira Fox and the State Attorney’s Office to save face with the people of southwest Florida is to file formal criminal charges against Betsy Rodriguez and fight for a conviction! We need justice to be served and that starts with a thorough and complete investigation, the filing of formal charges, and eventually a conviction of Betsy Rodriguez for hitting and killing Mikey. Please help us get Justice for Mikey and sign our petition.

●       With the state not filing charges, this sends a bad message to our community and all of Southwest Florida: If you hit and kill someone with your car, there are no repercussions.

●       Aren’t our roads dangerous enough as without sending this message of zero accountability to the general public for hit and runs that result in the death of a person?

●       As part of the Hispanic community of SWFL, we are feeling like we are not being treated equally in the eyes of the Justice system. I know hit and run cases are difficult to prosecute, but if the victim was a white teenager or person, there would likely have been charges filed. We need justice for all, not just a certain group!

●       This concerns all of us, if the State Attorney does not fight for this victim and his family, how can we be sure that she and her office will do the same if it happens to us.

PETICIÓN DE ENJUICIAMIENTO PENAL DE BETSY RODRÍGUEZ

POR GOLPEAR Y MATAR A MIQUEAS "MIKEY" PÉREZ-RAMOS

Nosotros, los residentes del suroeste de Florida, estamos solicitando las siguientes acciones:

●       Exigimos una investigación completa y exhaustiva de este caso por parte de la Oficina del Fiscal del Estado, o si existe un conflicto de intereses entre la oficina de Amira Fox  , entonces un fiscal independiente para manejar el asunto.

●       Exigimos que con la evidencia que el Estado ya tiene tengan pruebas suficientes para presentar cargos formales contra Betsy Rodríguez, y exigimos que esos cargos se presenten formalmente ahora.

●       Exigimos justicia para Mikey y su familia, lo que significa que la persona responsable debe rendir cuentas en los tribunales a través de un juicio o declaración de culpabilidad una vez que sea acusada formalmente.

 

El 13 de febrero de 2021, Miqueas "Mikey" Pérez-Ramos, de 18 años, estudiante de último año de secundaria, fue a su típica carrera matutina. Fue durante esta carrera matutina que fue atropellado por una camioneta y fue dejado morir en una zanja por un conductor de 55 años. El conductor del vehículo que atropelló y mató a Mikey era propiedad y estaba operado por Betsy Rodríguez. De hecho, la Patrulla de Carreteras de Florida investigó este incidente y la horrible muerte de Mikey. La investigación de FHP descubrió evidencia que demostró que la Sra. Ella podría haber hecho esto en la escena la primera vez, podría haber llamado cuando regresó a su casa, y podría haber llamado cuando regresó a la escena por segunda vez en otro vehículo con ese hombre desconocido, pero no lo hizo. En lugar de hacer la llamada al 911, Rodríguez dejó que Mikey muriera desangrado en la zanja en la que su automóvil lo arrojó esa mañana. Las pruebas obtenidas por FHP durante la investigación de esta tragedia confirman todos los hechos contenidos en esta Petición. Cuando FHP cerró la investigación y entregó el caso a la Oficina del Fiscal del Estado para su enjuiciamiento, parecía que Justicia por Mikey estaba a solo una información de suceder. Curiosamente, con toda la información contenida dentro de la investigación realizada por FHP, la Oficina del Fiscal del Estado encabezada por Amira D. Fox decidió no presentar cargos penales contra Betsy Rodríguez. Nosotros, la gente del suroeste de Florida, ahora preguntamos... ¿Dónde está la justicia para Mikey? Exigimos que se haga justicia. El primer deber de la sociedad es la justicia, y eso comienza con una investigación exhaustiva, la presentación de cargos penales y una condena de Betsy Rodríguez por matar a Miqueas Pérez-Ramos.

 

Ha pasado un poco más de un año y, a pesar de los continuos esfuerzos de nuestra familia, la comunidad de SWFL y nuestro abogado Casey Gartland del bufete de abogados Pendas, la oficina del Estado del Fiscal no había presentado ningún cargo penal contra la Sra. Rodríguez por golpear y matar a Mikey. El Sr. Gartland ha sido implacable en su búsqueda de justicia para Mikey. Ha hablado con la Oficina del Fiscal del Estado en numerosas ocasiones, ha intercambiado correos electrónicos con ellos e incluso ha aparecido en varios programas de medios de comunicación para tratar de que Amira Fox y la Oficina del Fiscal del Estado hagan lo correcto y presenten cargos formales contra la Sra. La policía reunió una gran cantidad de pruebas, pero incluso con esta evidencia, la Oficina del Fiscal del Estado todavía se niega a completar la investigación y presentar cargos formales. ¿Qué está deteniendo este proceso? ¿Es porque Mikey es hispano? ¿Es porque la Sra. Rodríguez conoce a alguien en la oficina del Fiscal del Estado? ¿Es una acusación selectiva? ¿Es este tipo de falta de acción contraria al juramento que la Sra. Fox tomó cuando se convirtió en Fiscal del Estado? Cualquiera que sea la razón, nosotros, la gente del suroeste de Florida, exigimos justicia para Miqueas Pérez-Ramos. Queremos que la Sra. ●       Dado que el estado no presenta cargos, esto envía un mal mensaje a nuestra comunidad y a todo el suroeste de la Florida: si golpea y mata a alguien con su automóvil, no hay repercusiones.

●       ¿No son nuestras carreteras lo suficientemente peligrosas como sin enviar este mensaje de cero responsabilidad al público en general por atropellos y fugas que resultan en la muerte de una persona?

●       Como parte de la comunidad hispana de SWFL, sentimos que no estamos siendo tratados por igual a los ojos del sistema de justicia. Sé que los casos de atropello y fuga son difíciles de procesar, pero si la víctima fuera un adolescente o una persona blanca, probablemente se habrían presentado cargos. ¡Necesitamos justicia para todos, no solo para un determinado grupo!

●       Esto nos concierne a todos, si el Fiscal del Estado no lucha por esta víctima y su familia, ¿cómo podemos estar seguros de que ella y su oficina harán lo mismo si nos sucede a nosotros?
