STAND-UP for JUSTICE:

“STOP FAIRFAX DEFAMATION”,

PROTECT the ARTS &
STOP ILLEGAL EVICTIONS

(An Independent Petition in Response to “STOP FAIRFAX NOISE” hosted on ipetitions.com)

In Support of “UNSEEN A/F” (Artist/Founder) Business Owner Frankie Ollervides & his UNSEEN CONTEMPORARY Community Art Gallery & Event Space

As concerned citizens of Los Angeles, joined by collaborating artists, members and supporters of the UNSEEN CONTEMPORARY “Family”, we are deeply troubled by the unjust business defamation being inflicted upon the artist, founder, and small business owner Frankie Ollervides. We stand together to raise awareness about the undeniable falsehood of several accusations that have tarnished his reputation considerably in the communities immediately surrounding his place of business - a business which we hold near and dear to our hearts as it not only serves as his personal art studio and Showroom/Gallery, but as a Creative Studio/Safe Space to numerous local and visiting artists, facilitating much needed communal and collective Artistic Expression.

Mr Ollervides has made this spot available at NO-COST to aspiring artists, stand-up comedians, musicians, and performers on a weekly basis for several years, The purpose of these incubators is and was to provide a safe-space for individuals to feel comfortable and and even supported on stage or in front of an audience for the first time and in the following ongoing early stages of building their craft, practicing their material with the benefit of professional sound and lighting equipment in an ever-evolving artistic setting curated by Frankie himself. Ultimately, these programs were developed with a strong emphasis on the the potential therapeutic benefits of working out any potential frustrations through a positive and creative practice. This became exponentially more crucial in early 2020 when racial injustices and pandemic anxiety was at a peak and it has remained relevant through our present time where we are experiencing a greater emphasis on mental health awareness than ever before.

These accusations and the irresponsible manner in which they have been presented and circulated have severely and adversely affected Mr Ollervides' ability to earn income and pursue beneficial business ventures and they have unjustly damaged his good standing with key business contacts as well as tainted opportunities with potential investors in
addition to potential new clients & collectors. It is both unfortunate and undeniable that these accusations and the distribution of this petition and it's comments have caused significant undue and unjust harm and distress in a multitude of other manners, absorbing an enormous amount of time and energy, creating unavoidable distractions that have interfered with and in many cases altogether sabotaged his ability to manage/execute business and personal priorities - and has ultimately brought severe emotional distress, ultimately jeopardizing not only the health of his business , but his personal health as well.

The most critical and certainly the most time-sensitive of the negative effects of this defamatory activity is the imminent illegal eviction proceedings that have been brought against Mr Ollervides and the UNSEEN CONTEMPORARY Art Gallery & Event Space located at 1030 South Fairfax as well as the property located above the gallery, which he leases from the same owner and which serves as the primary residence for Mr Ollervides as well as four other individuals.  The Property Owners started the eviction process shortly after the “STOP FAIRFAX NOISE” petition was sent around based on his alleged failure to comply with a Landlord generated “10-day Cure or Quit” re:code enforcement complaints/violations that had either been satisfied and closed with the Department of Building and Safety prior to 10-Day deadline, legitimate issues that were pre-existing conditions prior to his lease, and/or otherwise non-applicable demands related to another property and mistakenly inserted by the Landlord’s representative. When Mr. Ollervides questioned these points, the property owner did not provide any response in writing as requested, but responded verbally that the pressure they were receiving from the city attorney’s office was too great for them to do anything but agree to “remove the tenant”, one way or another, or - suffer consequences. The petition entitled “STOP FAIRFAX NOISE” which was addressed to the City Attorney has influenced and erroneously not only names, but actually singles out Frankie and his business as being the source of rampant community-wide despair that prevents the neighborhood from being able to sleep at night and significantly diminishing their overall quality of life. The only truthful claim among the petition’s noise complaints that was genuinely caused by Mr Ollervides involves the “loud metal-grinding” required to execute the specific code enforcement compliance orders a few days before the petition was generated.

The combination of this defamatory petition along with the expedited and unsubstantiated eviction proceedings is unethical and should be thoroughly examined and rectified.

We stand together in defending not only Frankie and his business, but in protecting the vital importance of these artistic outposts where artistic expression is encouraged and nurtured - and available to all who are willing to dedicate their energy to developing their craft, regardless of privilege.

Most importantly, we stand together to defend the TRUTH and take a stand against any person or entity that fabricates and circulates damaging fictitious statements about another individual and/or their business. Furthermore, the idea that these slanderous statements may be playing a part in a property owner’s decision to evict a tenant of over six years is unacceptable. Even more disturbing is the potential possibility that this defamatory document may be prompting a city official to apply pressure on a property owner to find a way to quickly remove a tenant that is allegedly causing these disturbances so that they might appease and satisfy their potential voters.

We believe it is essential to rectify this grave injustice by raising awareness about the truth behind these defamatory claims against Frankie Ollervides and UNSEEN ContemporaryArtGallery. And we believe it is essential to ensure that illegal eviction processes are not in any way being condoned, or even worse - facilitated - by city officials that have been elected to represent the people, defend our legal rights and ensure that Justice prevails.

By signing this petition, we demand that:

1. The Los Angeles City Attorney conduct a thorough investigation into the source of these false accusations.

2. The City Attorney publicly acknowledge their mistake in attributing all disturbances solely to Frankie's establishment.

3. Local media outlets provide fair coverage regarding this issue by presenting accurate information.

4. The eviction procedures initiated against Frankie Ollervides by his landlord be halted immediately.

We understand the importance of maintaining a peaceful and harmonious neighborhood, but it should not come at the cost of unfairly targeting one individual and their business - and certainly not by turning a blind eye when false accusations and illegal defamatory practices constitute the foundation of the Let us stand united to protect the livelihoods of small business owners like Frankie, who contribute immensely to our city's cultural fabric.

Together, we can ensure justice prevails!
