The recent blanket ban on ownership of pets at Skyluxe Residence, Bukit Jalil is unlawful and ignorant. This unilateral blanket ban by the Management of Skyluxe contradicts the by-laws enacted by Kuala Lumpur City Hall (“DBKL”) in 2011 under section UUK8A wherein it is stated that pet ownership is permitted in high-rise apartments subject to possession of a pet license.

In addition to being unlawful by enacting independent by-laws contradicting the law of the land, the resulting penalties imposed on the possession of pets in the premise are clearly ignorant and outright illegal. The associating fines and forceful removal of pets by the management office is clearly a breach of jurisdiction and abuse of authority. 

The undue strain this unlawful ban has placed on the community must not be understated. Residents with pets are placed under immense pressure as they seek resolution, with fears of giving up their pets to shelters, abandonment, and even euthanization. This false dilemma plaguing some families may well leave them distraught and shattered.

Understandably, pet owners should ensure that all pets are leashed and restrained in all common areas, observing necessary rules and care in cleaning up after their pets (to the best of their ability and within reason) in events of uncontrolled discharges. Concise rules should be drafted governing the ownership and maintenance of pets on the premises, with feedback from pet owners so as to ensure logical and feasible governance. 

An observable degradation of the social fabric of the community has occurred as an effect of this blanket ban, with forms of intimidation occurring from those with viewpoints opposing pet ownership and resulting retaliation of pet owners. This resulting duress placed upon the community may well disrupt the "enjoyment of the premises and its facilities." (Owners handbook 1.1 a) (ii)

It is imperative that we foster a community of harmony, understanding, and tolerance and such ignorant and hardline stances deserve no place in our community. I urge the Skyluxe Management Office to take the necessary steps in resolving and reversing this blanket ban promptly for the benefit of the community. Should a pet license be required by the Management Office, we seek the cooperation of the Management Office in issuing the relevant written approvals, allowing pet owners to apply to DBKL for the necessary licenses. 

It is paramount that we steward a community that is empathetic and tolerant to all, despite differing viewpoints we should strive to constructively address disputes in a manner that is just, and in the purview of the law.
