SB 3EX, Section 1.1 would require a separate hand count of the top two races on every ballot before election results can be certified. First, this mandate is unnecessary. Second, it is impractical and costly to implement. Counties across Georgia could face up to $60 million in additional expenses, yet no funding has been appropriated to cover these costs.
The proposal would also significantly increase the risk of delays, human error, and political interference in the election process. Extended certification timelines and inconsistent implementation could create confusion among voters and strain local election offices.
These impacts would affect all Georgia voters. However, communities that have historically faced barriers to political participation—including many Black voters—could be disproportionately affected if election administration becomes less efficient, less accessible, or less trusted. Delays and uncertainty in the certification process can undermine public confidence in election outcomes and weaken faith in democratic institutions.
