The Issue
Due to recent events, including Mayor Burton using a loophole in a procedural bylaw to remove an agenda item leading to not allowing 24 registered delegates speak about a very important issue to them during the January 29, 2024, council meeting. In doing so, Mayor Burton stated, "It also appears some members of the public may see the meeting [tonight] about the item as a platform to use to promote hatred and divisive antisemitic views. Delegations tonight appear to be intending to be problematic too."
Mayor Burton also showed bias in his decision to remove the addenda item at the January 29, 2024, because he allowed a similar topic to proceed in a council meeting on February 28, 2022.
There has been a formal integrity complaint filed against Mayor Burton relating to his shown bias and potential systemic racism. In addition, the actions of Mayor Burton breached the rights of the registered delegates under The Canadian Charter of Rights and Freedoms, including under sections dealing with their Fundamental Freedoms and Equality Rights.
Mayor Burton did not treat the registered delegates with respect and therefore breached section 6 of the Council Code of Conduct inserted below:
Section 226.1 of the Municipal Act, 2001, S.O. 2001, c. 25 inserted below outlines the expectations of the Head of Council and CEO of the Town, which role is held by Mayor Burton. It appears Mayor Burton's recent actions breached sections 226.1 (b) and (d).
