HUMBLE APPEAL OF ILL-FATED EPS POOR OLD AGED PENSIONERS /SENIOR CITIZENS ON EPS95 PENSION
The Issue
We, the old aged poor EPS 95 Pensioners/senior citizens/retirees, would like to bring to your kind personal notice that 26 years ago, ie, on 16th November 1995, Government of India, introduced Employees' Pension Scheme (EPS 95) with a view to provide Pension to the retirees of Public and private sector retirees as a Social Security.
The scheme was to be revised for every 10 years. However, during this 26 years, the same was not revised even once. Presently we are getting a meagre amount of Rs.1000/- as minimum pension. Even Koshyari Committee recommendations were not implemented. By considering present value of minimum pension recommended by Koshyari Committee, it will be definitely more than Rs.9000.
Thereafter some of our retirees have approached the Courts, and in all the cases, the High Courts and the Supreme Court have passed judgements in favor of the pensioners that the pension is to be revised and calculated on the basis of the actual salary received at the time of retirement. One such Judgment was that of RC Gupta case passed by the Supreme Court on 04-10-2016. From then onwards EPFO has been filing appeals after appeals and putting all sorts of hurdles in implementation of the Judgment. The latest trick being played jointly by EPFO and Government of India to represent to the Supreme Court that revision of pension to EPS 95 pensioners is not financially viable. With this argument EPFO and GOI are trying to unsettle the settled law and Judgments of the Supreme Court.
As per the RTI replies received from EPFO from 11/1995 to 26/11/2021, 11,54,365 EPS 95 pensioners already died. Many of us are at the fag end of our lives, solely dependent on our children due to inadequate pension and decrease in the rates of interest on FDs etc. The same has been brought to your kind notice earlier on many occasions but unfortunately could not get any relief sir.
We, the poor senior citizens congratulate you sir for withdrawing three FARM laws and we would request that the Review petitions and SLPs filed by EPFO and GOI against the settled principles of law as pronounced by the Hon'ble Supreme Court, may also please be withdrawn, to pave the way for implementation of the earlier verdict dated 4-10-2016 of the Apex Court.
