  WHEREAS, The Ohio Constitution: Article 1, Section 4, states that “The people have the right to bear arms for their defense and security;” and 

WHEREAS, The 2nd Amendment of the Constitution of the United States of America states ”A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed”; and 

WHEREAS, The 2nd Amendment of the Constitution of the United States of America was ratified in 1791, and is still the Law of the Land; and 

WHEREAS, Article 6 of the Constitution of the United States of America states “This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or laws of any State to the contrary notwithstanding;” and 

WHEREAS, Article 15, Section 7, of the Constitution of the State of Ohio declares: “Every person chosen or appointed to any office under this state, before entering upon the discharge of his duties, shall take an oath or affirmation to support the Constitution of the United States, and of this state, and also an oath of office;” and 

WHEREAS, Sheriff Paul Monroe, County Commissioner Daniel Polivka (President), County Commissioner Mauro Cantalamessa, and County Commissioner Frank Fuda have all taken such an oath and believe it to be binding upon them morally, ethically, and legally; and 

WHEREAS, the Sheriff and the Trumbull County Commissioners fully affirm their support of the rights of law-abiding citizens to keep and bear arms and stand firm against any law or ordinance on any level of government to remove that right from any law-abiding citizen without due process; and 

WHEREAS, the Sheriff and the Trumbull County Commissioners will not authorize any county official to expend county funds for the purpose of enforcing illegal or unconstitutional laws or ordinances that seek to limit a law-abiding citizen’s right to keep and bear arms; and 

WHEREAS, the Sheriff and Trumbull County Board of Commissioners believe the most prudent way to prevent gun violence is (1.) to address the growing mental health crisis, (2.) to hold

those accountable who would propose to disarm law abiding citizens, and (3.) to enforce the existing law; and 

WHEREAS, the citizens of Trumbull County, Ohio, derive economic benefit from lawful use of firearms, including hunting, recreation and shooting sports; and 

NOW, THEREFORE, BE IT RESOLVED by the Sheriff and the Board of County Commissioners of Trumbull County, Ohio, by the authority granted the Board by the laws of the State of Ohio and the people of Trumbull County, Ohio, to defend the rights and liberties guaranteed by the constitutions of The United States and The State of Ohio, that we hereby declare this Resolution to be a “Second-Amendment Preservation Resolution” and declare Trumbull County, Ohio, a “2nd-Amendment Sanctuary County;” and 

BE IT FURTHER RESOLVED that this Sheriff and the Board of County Commissioners does hereby pledge to not appropriate funds, resources, employees, or agencies to initiate unconstitutional seizures in unincorporated or incorporated Trumbull County, Ohio; and 

BE IT FURTHER RESOLVED that the Sheriff and Board of County Commissioners demands that the state and national legislatures cease and desist all current and future actions directed at restricting the Second Amendment rights of lawful citizens. 

Moreover, upon being sworn to the public office, politicians, whether local, state, or federal, recited and swore to an oath to support and defend the Constitution of the United States of America as per Title 5 U.S. Code, Section3331.  

Moreover, on your own recognizance, you admitted you would; ...take this obligation freely, without any mental reservation or purpose of evasion; and that you will well and faithfully discharge the duties of the office… 

Within 60 days of accepting employment from We the People, you were to complete an affidavit as per Title 5 U.S. Code, Section 3333, stating that you would not violate Title 5 U.S. Code, Section 7311, which states; “An individual may not accept or hold a position in the Government of the United States or the Government of the District of Columbia if he...advocates the overthrow of our constitutional form of government.” 

Moreover, a provision of Executive Order 10450 specifies it is a direct violation of Title 5 U.S. Code, Section 7311 for any person taking the oath of office to advocate, “The alteration of the form of government of the United States by unconstitutional means.”  You will have violated not only your oath, for which I refer you to the Loyalty Clause of Article 6, Section 3 of the U.S. Constitution, but also would be in violation of Title 5 U.S. Code, Section 7311.  According to Title 18 U.S. Code, Section 1918, you would be entitled to your due process, and if found guilty you

shall be fined and/or imprisoned for not more than one year and a day, and never to be allowed to hold public office again. 

Whereas, by advocating for gun legislation in any manner within the State of Ohio, you will have also violated Title 18 U.S. Code, Sections 201, 241, 242, 2382, 2383, and Title 42 U.S. Code, Sections 1983, 1985, and 1986. 

It is imperative that we understand that Volume 18 reflects the law as it was known to exist after the 14th Amendment in 1868. In that Volume, Congress published a section entitled “The Organic Laws of the United States of America.” That section includes among it, four specific documents. They are: 

1) The Declaration of Independence 

2) The Articles of Confederation 

3) The Northwest Ordinance 

4) The Constitution of the United States 

In Summary, if you violate your oath to the Constitution, you also violate your oath to the other three organic laws. Moreover, we, and you, must understand that the Bill of Rights is not our source of rights, but rather, a list of restrictions against the government and it’s agents. We the People thank you not only for your service to this great land, and to us, but also for your adherence to your oath.
