The evidence is overwhelming and it is important to have Earl's civil rights respected at some point in time.  We have been fighting for criminal charges for almost 4 years to the date.  Deaths within custody too often are overlooked and the officers responsible always walk.  Civil trial is June 2014.  Please don't let Earl just be a dollar figure. This was a hate crime.  Earl was HIV positive and bit the arresting officer.  Seven hours later he was taken into a cell by 5 or 6 sheriff's.  He was handcuffed,hog tied, and shackled, beaten for 12 minutes and was pronounced dead at the jail, never going to the hospital. The coroner, Dr. Ellen Moffat lied on her cause of death report and as much admitted so under deposition by omitting several key factors present during "in custody" deaths. The FBI'S report is in stark contrast to the District Attorney's report as to what happened to Earl.  The toxicology report has been dismissed as well.  Earl didn't have a lethal dose of any type of drug in his system.  Please pass this along to the LBGT community in San Franciso and sign this so my mother can rest knowing that her son is vindicated.  This type of behavior has been present throuhout the history of our country.  It's time for someone to help us bring change.  Earl was not a "nigger" or a "faggot with Aids."  He was a son, brother, lover, citizen and most importantly a human being.  Black, gay men are not welcome in San Francisco and have no value to the DOJ Civil Rights Division.  Earl was very accomplished.  He was a Graduate of the Air Force Academy, Class of 1988, 11th Squadron, UNC Law School, Class of 1994, Patent Attorney, passing the bar exam in Georgia, Alabama, DC, New York and California.  Earl was also a decorated Gulf War Vet that took part in the countermeasre system on the B1 Bomber. He was Pentagon employed, and a great man!!

My purpose of this petition is to show other families, THEY DO HAVE A VOICE.  Rely on no one but yourself, attorneys and forensic pathologist.  Dr. Werner Spitz's cause of death, which I'll post online shortly, is in sharp contrast to the Medical Examiner's report.  Below are some of the cases he's worked on.
