“Without a sworn affidavit of probable cause, there was nothing for the issuing authority to evaluate… Consequently, the arrest warrant issued for Appellant was invalid.”

— Commonwealth v. Johnson, 34 A.3d 251, 255 (Pa. Super. Ct. 2011)

-The Pennsylvania Supreme Court held that a criminal complaint or arrest warrant must be supported by a properly sworn affidavit.
-Unsigned or unsworn affidavits are constitutionally defective and violate both the Fourth Amendment and Article I, § 8 of the Pennsylvania Constitution.
-A warrant issued without a sworn affidavit is facially invalid, and any arrest made under such a warrant may be unlawful.

I can only post one update every 24 hours.

I will be posting a piece of the timeline every day.

The story sounds so unreal and just plain crazy and I know it’s even hard to believe it could be true.
