On November 14, 2024, Zamirah’s private defense attorney admitted in open court:
“She was not driving during that incident, literally. Like, the charge was originally dismissed at the magistrate and refiled without a new preliminary hearing by information. So we’re ready to go.”

In Pennsylvania, if a case is thrown out at the magistrate level, the Commonwealth must schedule a new preliminary hearing before restarting the case. That never happened.

The district attorney said nothing.

Her own attorney didn’t challenge it 🚨🚨🚨🚨 even after saying it out loud that no hearing was held.

Without a new preliminary hearing, the court has no legal jurisdiction to move the case forward. But instead of dismissing it, the judge simply asked, “How much time do you need at trial?”
****On top of that, they upgraded the charge.
In May 2024, they changed the charge to a second-offense DUI (which carries harsher penalties), even though there was no conviction on the first case yet. This is against the law.
