Seek Justice in the Succession Case No. 274 of 86 involving the late Tabitha Muthoni

The Issue

My name is a deeply tied part of the decades-long succession case No. 274 of 86 involving my late mother, Tabitha Muthoni. Despite her death, her legacy remains embroiled in a legal battle against Kuria Muchunu, the respondent in the High Court civil appeal No. 126 of 99.

This legal journey has not only taken a physical toll on us, her family, but it also strains the memories we have of her, overshadowing them with painful court proceedings and ongoing legal squabbles. It represents the struggle of many families in our country entangled in similar succession disputes.

The Kenyan judiciary annual report of 2018/19 acknowledged that succession cases like ours constitute a significant percentage of the civil cases in courts [Kenyan Judiciary Annual Report]. Yet, these cases represent more than mere figures or statistics. They signify lives put on hold, inheritances left inaccessible, and the summary dismissal of the last wishes of many departed souls.

In this spirit, we beseech the High Court of Kenya to expedite the resolution regarding the civil appeal No. 126 of 99 relating to the succession case No. 274 of 86. We seek justice, closure, and a chance to honour Tabitha Muthoni's memory free from the lingering shadow of this dispute.

3. Jane Wanjiru left behind three daughter
a. Eunice Waithira
b. Tabitha Muthoni
c. Lusiah Wanjiku
The three daughters are now married
4. Jane Wanjiru Njuguna alias Thitwa has left a land belonging to her deceased husband Thitwa
Mworia, two houses kitchen and dining house, and a cow (guoya). She has not shared her
land to anyone.
5. As a clan we have unanimously agreed that the house be demolished and the building
materials to be shared among them all three (3) daughters. They will also share the cows and
the land parcel number 584 that is within Mukuria Scheme Loc3. (LOC3/MUKURIA/584).
