The Issue

Johnny Munoz is more than a name. He's a beloved son, nephew, grandson, friend, a cherished member of our community in Cheyenne, WY, and an innocent young man wrongfully convicted of 2nd degree murder. This sweet kid has touched many hearts throughout his life and his wrongful conviction has sent shockwaves through our community.

Johnny hasn't had an easy life. Despite the hardships he faced growing up, he remained kind-hearted and compassionate to all who knew him. His story is not one of violence but one of resilience and strength.

The evidence presented in court clearly proved Johnny's innocence. Yet the jury got it wrong in this case - a devastating blow to both Johnny's family and those who believe in his innocence within our community.

We believe Johnny was solely convicted on circumstantial evidence with no direct proof linking him to the crime. During trial new evidence was presented showing several kids from the park in possesion of firearms. Footage showed these same kids hiding evidence at a home near the park. The Cheyenne Police Department failed to conduct a proper investigation. Therefore the integrity of the investigation was compromised by lack of a thorough search of the vehicle and a prompt collection of physical evidence. 

Here are several key points that raise questions about the fairness and accuracy of the conviction:

  • Inconsistent Witness Testimonies from individuals at the scene of the crime, most of whom were under the influence of alcohol and marijuana.
  • Mislabeling of Firearms causing the failure to conduct ballistics on a relevant weapon. 
  • Inadequate Collection of Evidence officers reporting there being a damaged shell casing and the possibility of evidence being removed. Crime scene was not properly secured.
  • Interview with a kid who was present at the scene of the crime who stated "he knew the other type of shell casings that were found besides the .9mm shell casings" before any of that information had been released.
  • Overlooked Alternatives and Additional Suspects which has raised concerns about the thoroughness of the CPD's inquiry.
  • The Lead Detective in the case expresses his concerns about reasonable doubt. Also stating he "absolutely" had his own theory, that went along with the same theory of the brother of the victim,  that someone from the park was responsible for the killing. 

Wrongful convictions are unfortunately not rare occurrences in the United States legal system. According to the National Registry of Exonerations, there were over 2,400 known exonerations from 1989 through February 2017 (source: National Registry of Exonerations). Each one represents a person like Johnny whose life was turned upside down due to errors or biases within our justice system.

We cannot stand by while another innocent person pays for a crime they did not commit. We must fight for justice for Johnny Munoz - because every individual deserves fair treatment under law.
