Fellow Texans, 
 
There are more than 900+ Battery Energy Storage Systems (BESS) not including solar and wind projects planned across Texas with more than 1000 Facebook pages created in reference to trying to stop these. With this petition, it is my hope that WE can stop the progression of these unsafe builds in Texas.  


Starting with why to stop them. First and foremost, we should learn from our past mistakes and not ignore the history of the progression of energy for the grid. In Texas we have already established oil and gas. When the production of these were first generated there was a large mess left in their wake. So much of a mess that it is still being cleaned up today. At least with gas and oil we have the full life process. The beginning, the middle, and the end. We even now know how to mitigate the sour gas that is known to pollute the atmosphere, explode and cause death. (remember this!) With renewable energy we have a beginning, at best a “middle”, but no actual end of life. They cannot be destroyed, and they cannot be placed in a landfill (thrown away) due to its toxic components, primarily lithium (BESS). There is also no known way to stop a fire in these once a fire begins. Once fire begins in a BESS they are left to burn out while exposing toxic plumes to those working the fires and the environment around it. For example, Fredericktown, Missouri. By now many have heard of this fire. A lithium processing plant with “state of the art safety measures” had multiple runaway explosions October 2024. According to the ICC (Internation Code Council) head of Texas (Obrian), 30 of the same batteries could catch fire with each having a different toxic chemical release during the fire. Meaning that with each new explosion a new toxic chemical is released into the toxic plumes. EPA had 22 sensors monitoring the fires but only released information from 7 of the sensors, all of which were down-wind. What of the other 15 sensors? 3 miles UPWIND of the fires there was a substantial number of fish and wildlife found dead. Seems like the upwind sensors they did not release may have some pertinent information to the American People. One could even call it evidence of just how unsafe these are.  


There is more attention being brought to these matters via our officials in the last month. Things our elects have done/said: 
Federal Senator Marco Rubio and 26 other Federal members signed a letter on December 1st, 2023, in reference to CHINA being able to access the software on Lake Lejeune Military Base. After it was discovered that China could remotely access the software within a BESS facility remotely, the military turned the system off. That is when they learned that China was then able turn the systems back on remotely. Because of this, these builds had to be decommissioned (removed) from the miliary bases. (Also recommend looking into the number of young individuals that were diagnosed with cancer from that base around this same time.) 

Supreme Court covered further issues of cyber vulnerabilty to our infrastructure and grid over a 20 year implementation from China.

Governor Abbott issued an executive order (GA-49) on November 19th, 2024 in reference to concerns of CHINA being able to access critical parts of infrastructure. The information being collected/gathered for Abbott is to be collected by January 15th, 2025. The results have been received and reviewed. This is only being made available by request, otherwise it is not being made public and this should tell you a lot.


Attorney General Paxton issued a lawsuit on November 27th, 2024 in reference to fraud done on the energy market. The lawsuit is against Blackrock (large shareholder Douglas Emhoff- Kamala Harris husband), State Street (connected to Blackrock) and Vanguard for illegally conspiring to manipulate energy markets, driving up costs for consumers. “Texas will not tolerate the illegal weaponization of the financial industry in service of a destructive, politicized ‘environmental’ agenda.” The three companies “formed a cartel to rig the coal market, artificially reduce the energy supply and raise prices.” 
 

Senator Hall-While man-made EMPs, often associated with high-altitude nuclear explosions, can be intentionally deployed as weapons, natural EMPs, such as those caused by solar weather, can occur unpredictably. The statistical likelihood of a major solar storm devastating our grid is a near certainty – we just don’t know when it will happen. Therefore, EMP protection is vital for national security and economic stability. A large-scale EMP event could cripple power grids, telecommunications, and financial systems, creating widespread chaos and hindering the response to other emergencies.


Congressman Lance Gooden released a letter November 25th, 2024 in reference to Van Zandt County (where I live) due to concerns over proper regulation and concerns of safety. Stating that Van Zandt county is NOT a testing ground.


More on the situation happening in Van Zandt County:  
There are 9 builds planned within our county in reference to grid support utilizing BESS and renewable energy. There is already one solar facility in our county and in 2024 the fire department had been toned 60+ times for this location. The same company is wanting to build a BESS next to a Pipeline (Federal- Explorer Pipeline) that carries sour gas, jet fuel and diesel with the closest shut off >35 miles away, closest full time fire department is >15 miles away (neighboring county), and closest hazmat is more than 90 minutes away. It is also evident that this company does not care about the land or its animals. The protected animal assessment that they did shows that they are aware that a threatened Texas small-headed pipewort is on the property. Furthermore, there is a bald eagle nest within a stone throw of the build. A build in which the parameters of which fall under the Parks and Wildlife impacts to their habitat, mating and even the stability of their eggs (chemicals make them so thin they break before growth or hatch). 
 
TCEQ, EPA and Parks and Wildlife have all advised that they only get involved in “aftermath”.  When it is too late! 
 
The purpose I hope to see come from this petition is to arm our legislation with evidence that the Texas People DO NOT WANT THESE until they are better regulated, safer and AMERICAN MADE. Please sign and help us stand together to show that our voices do matter!

Representatives Hopper, Schatzline, and Tinderholt proposed an amendment to the Bill which was defeated, unfortunately. Now this Bill moves to the Senate.
