The Issue

 

To the Esteemed Planning Commission Board and the Board of County Commissioners:

We, the undersigned residents and homeowners of Sea Pines Community, are a residential community located in Hudson, Florida, respectfully submit this petition to oppose the proposed zoning change that would allow the parking of recreational vehicles (RVs) within our neighborhood.
Our community is defined by its high standards, aesthetic qualities, and the preservation of property values. The proposed zoning amendment poses a significant threat to the character of our neighborhood and to the investment of its homeowners. Below, we outline the legal, environmental, and community concerns that form the basis of our opposition.


1.    Potential Reduction in Property Values and Economic Impact
 
Florida Statutes, Section 163.3202 (Comprehensive Plan) and Section 163.3177 (Comprehensive Planning Act) require that zoning and land-use decisions are made with due regard to their impact on local property values. In line with these statutes, allowing RV parking within Sea Pines is likely to cause a devaluation of properties in our community. Real Estate professionals’ testimonies that properties near RV parks or areas designated for RV parking often experience a decline depending on the proximity of the facility. Again, this potential RV park is within our community.
 •       F.S. § 163.3202 (Comprehensive Plan) requires local governments to ensure that zoning decisions are consistent with the local comprehensive plan and do not undermine the welfare of the community. The proposed zoning change undermines property value and the planned character of Sea Pines.
•       F.S. § 163.3177 (Comprehensive Planning Act) states that zoning amendments must be compatible with the surrounding properties and uphold the integrity of existing neighborhoods. Allowing RV parking within Sea Pines Community is inconsistent with the surrounding residential areas, which were developed with a specific aesthetic and property value in mind.
The presence of RVs, trailers, and large vehicles is inconsistent with the aesthetic expectations of residential properties in our community, and this change would likely diminish the attractiveness of our neighborhood to prospective buyers. This, in turn, can result in long-term financial loss for homeowners within Sea Pines.

 
2.    Environmental and Safety Concerns
 
Florida’s Department of Environmental Protection (FDEP) enforces strict regulations regarding water runoff, waste management, and pollution in residential areas. Large vehicles such as RVs may present risks related to oil leakage, fuel runoff, and other environmental hazards. Additionally, these vehicles may contribute to soil compaction and drainage issues, which can negatively affect our community & apos;s landscaping and surrounding natural areas.
 
•       F.S. § 403.703 (Solid Waste Management Act) and F.S. § 403.726 (Pollution Control) address issues related to environmental protection, such as runoff and hazardous waste. The potential for water and air pollution from RV parking areas must be considered in evaluating this zoning change.
 
Moreover, Florida Statutes Section 316.302 (Transportation of Vehicles) imposes requirements on the safe operation of motor vehicles, including RVs. The introduction of large, mobile vehicles in an area not designed for such use could pose safety risks to pedestrians, children, and other residents. Maneuvering large RVs on residential streets and parking them in close proximity to homes could also compromise traffic flow and increase the likelihood of accidents.


3.    Potential for Noise, Traffic, and Disturbance
 
The Pasco County Code of Ordinances recognizes the importance of maintaining peace and quiet within residential areas. RV parking facilities often generate excessive noise, particularly when vehicles are driven in and out of the area, or when RVs are utilized for camping or other activities.
•       Pasco County Code of Ordinances, Section 66-97 Division 2 (4) (Noise Created within Residential Zones) requires that residential areas maintain a quiet and peaceful environment. Allowing RV parking may result in disturbances such as noise from RV engines, air conditioning units, and the frequent movement of large vehicles, which would impact the quality of life for Sea Pine residents.
The introduction of RV parking in the vicinity of our neighborhood would likely lead to increased vehicular traffic, noise disturbances, and reduced privacy. These effects are especially concerning for elderly residents, families with young children, and others seeking the peaceful living environment that Sea Pines currently offers.

 

4.    Legal Precedents and State Statutes Supporting Our Position
 

Florida law recognizes that zoning decisions must be made in a manner that protects the health, safety, and welfare of the public. The Florida Growth Management Act (Section 163.3161-163.3246) outlines the requirement for municipalities to adopt comprehensive plans that include land-use policies aimed at preserving residential property values and quality of life.

•       F.S. § 163.3161 states that the comprehensive plan must include policies to enhance the quality of life for residents and protect the public welfare. The proposed zoning change would be detrimental to these goals and could negatively affect Sea Pine's property values and safety.

Moreover, as confirmed by Florida courts in cases such as Lee County v. Sunbelt Development Corp. (2001), zoning amendments may be denied if they do not align with the general welfare of the community, and when they negatively affect property values and the overall quality of life of residents.

•       Lee County v. Sunbelt Development Corp., 784 So. 2d 442 (Fla. 2d DCA 2001): Court held that zoning changes should not be made if they are inconsistent with the public welfare and will lead to harm for surrounding property owners.

Conclusion and Request for Action:
 

Given the significant negative implications of the proposed zoning change on the quality of life, property values, aesthetic standards, and safety within Sea Pines, we respectfully request that the zoning authority take the following actions:

1.    Deny the proposed zoning change that would allow RV parking within Sea Pines.

2.    Ensure that any future zoning changes within our neighborhood adhere to the guidelines set forth in the Pasco County Code of Ordinances, as well as Florida Statutes, to protect the interests of property owners.

3.    Uphold the original vision for the community, which has been carefully planned to maintain high property values and quality living standards for all residents.

We acknowledge the need for economic development, but not at the cost of our community’s values and natural environment. Alternative sites for RV parks should be considered, areas where they support local businesses without detracting from the charm and integrity of well-established neighborhoods such as Sea Pines.
