Say "No" to Arizona's Immigration Bill -1070

The Issue

 

Arizona's Immigration Senate Bill- 1070 Ignores a Human's Rights, promotes discrimination based on unregulated lawful suspicion. We must remind Arizona that all human beings are entitled to all the rights and freedoms without distinction of any kind. 

Targeted Discrimination

Arizona’s SB-1070 – Gives Law Enforcement the right to take action against an individual, “Alien”, based on skin color, appearance, and stereotypes. According to Section B.

The Universal Declaration of Human Rights counters the SB-1070 by stating: 

Article 1 All human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood.

Article 2 Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status. Furthermore, no distinction shall be made on the basis of the political, jurisdictional or international status of the country or territory to which a person belongs, whether it be independent, trust, non-self-governing or under any other limitation of sovereignty.

 

Invasion of Privacy/ Unregulated Power

Arizona’s SB-1070 – Law Enforcement is not required to use a warrant and can freely arrest a suspicious person, someone who looks like an “Alien” with “probable cause.” According to Section C.

Arizona’s SB-1070- permits the invasion of privacy based on suspicion, Law Enforcement Agencies can freely acquire information about an “Alien’s” immigration status without restriction. According to Section F.

The Universal Declaration of Human Rights counters the SB-1070 by stating: 

Article 9 No one shall be subjected to arbitrary arrest, dentention or exile. 

Article 12 No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation. Everyone has the right to the protection of the law against such interference or attacks.Article 13 Everyone has the right to freedom of movement and residence within the borders of each state. Everyone has the right to leave any country, including their own, and to return to their country.

Lawfully unequal

Arizona’s SB-1070- Penalizes “Aliens” for taking action against Law Enforcement and U.S. government agencies. The “Aliens” who take action incur all court costs, attorney fees, and must pay a civil penalty of $1,000 to $5,000. Unclearly stated in Section G&H.

Arizona’s SB-1070- ascribes no blame or responsibility to Law Enforcement actions against “Alien” who may choose to take civil action. Law Enforcement Agencies are impenetrable and are INDEMNIFIED against incurring any cost if civil action is taken by the “Alien” unless the Law Enforcement acted in “bad faith.” How can “bad faith” be defined when Law Enforcement agencies are free to pull a person over and or arrest an individual based on suspicion of looking like an “illegal” Alien. According to Section I.

 

The Universal Declaration of Human Rights counters the SB-1070 by stating: 

Article 7  

All are equal before the law and are entitled without any discrimination to equal protection of the law. All are entitled to equal protection against any discrimination in violation of this Declaration and against any incitement to such discrimination.

Article 8

Everyone has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law.

Article 10

Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him.

Article 11

Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defense.

No one shall be held guilty of any penal offence on account of any act or omission which did not constitute a penal offence, under national or international law, at the time when it was committed. Nor shall a heavier penalty be imposed than the one that was applicable at the time the penal offence was committed.
