The Issue
On the morning of August 17, 2023, an unexpected incident occurred at my home in Culpeper County. A (now former) deputy arrived at 7:12 am unannounced or contacting dispatch of her in route location to deliver a civil paper intended for my son who no longer resides with me. Instead of using the front door as per standard policy and procedure, she came traipsing upon my property to my back door where she attempted to enter my enclosed back deck area posted with dog signage on the gate where she encountered my dog Kuro.
My driveway was also posted beware of dog and No Trespassing signage.
The day of the incident no charges were brought against Kuro or me by law enforcement investigator that came to my home or Animal Control,
Animal Control followed the Virginia law statue that any dog defending itself, its property, its owner, or its offspring can not be found dangerous or vicious, however 2 weeks later on 8-31-23 under the authority of the former Sheriff Scott Jenkins (who currently has federal charges and was found guilty on 12 counts by a jury) charges were brought against Kuro by Cpt.J.A. Curtis for a vicious dog warrant asking for him to be euthanized under Va code 3.2-6540.1 section C, Aug. 31,2023 Scott Jenkins came to my home with many of his serving law enforcement officers under him and picked up my dog Kuro who has been held at the Culpeper County Animal Shelter ever since.
There was a hearing to be heard on Sept. 18,23 for the charge, but was continued to Sept. 20,23 as my attorney at that time could not be there for the original set date.
On Sept. 19,23 I received a phone call from my attorney informing me that the asst. Commonwealth attorney was threatening felony charges if I continued forward with defending Kuro on Sept. 20th.
I could not believe what I was hearing..Why would they do this? I didn’t do anything wrong and neither did Kuro! They want me to just let them kill my dog!
Sept.19,23 4 weeks after the incident Capt. J.A. Curtis obtained 2 felony charges against me under the same Va. code 3.2-6540.1 section D for being the cause of a vicious dog biting someone and having no remorse for a human life.
I was completely devastated and was trying to wrap my mind around what they were doing to me and Kuro!
From Aug.31,23 thru Feb.13,23 Kuro had no out of kennel movement orders of the sheriff office under Jenkins until a volunteer got involved and Kuro was then allowed to be taken out of the kennel by us for the first time on 2-13-23 after sitting for 6 mos then on Feb.14,23 I get a phone call from animal control telling me Kuro can not go back outside because someone called the county administrator complaining it would hurt the jury trial if he was outside. Thankfully though this was overturned and Kuro was allowed to go back outside again.
We went to circuit court on April 5, 24 and it ended in a hung jury 4-3 a mistrial so another jury trial to be set to hear the case again ordered by the commonwealth, All the while Kuro will still be confined to the animal shelter.
A second jury trial was scheduled for Oct.16,24 and a plea was presented to my attorney for the first time. I was led to believe Kuro would be coming home and this nightmare would end, however what was agreed upon between my current attorney and what the commonwealth offered in a plea differed the day of the trial by the commonwealth. I did not initially want to take the plea offer and I cried out to God about doing so, but it was supposed to free Kuro with no dangerous or vicious dog label so I acted selflessly to save my boy to get him out of the suffering he was and has endured by being confined for so long.
Now another jury trial has been set for Feb.10,25 while Kuro is still detained at the animal shelter for a total of 19 months Without any incidents or issues being there and has proven time and again he is a great dog! Animal control continues to follow the Va. code. Just wanted to update the court hearing is now scheduled for Feb.20,25 @ 9:30 circuit court culpeper Va.
Update: on February 20,25 another jury trial was scheduled for July 18,25 also, a motion to release Kuro from the animal shelter was filed and is to be heard April 3,25 in culpeper circuit court in front of the residing judge Honorable Melvin Hughes out of Richmond Va. Judge Hughes was appointed to reside over the case because the original circuit court judge Dale Durrer filed a rebuttal when the case first started and have heard several reasons for him doing so, after the rebuttal was filed the case was assigned to reside under retired Honorable Judge Brown, but right before the first jury trial in April 2024 it was assigned to reside under Honorable Judge M. Hughes from Richmond Va.and has remained residing under him.
This action is all by the Culpeper Sheriff office and the Culpeper Commonwealth to defend a previous deputy who did not follow protocol and training received for proper civil paper service.
This unfortunate event has led to my dog being unfairly taken and labeled as dangerous or vicious. This situation could have been entirely avoided if the officer had adhered to her work manual and followed proper procedure by approaching via the front door - a public access point - instead of intruding into a private living space where pets reside.
It is essential that law enforcement officers follow established protocols when delivering civil papers. These procedures are in place not only for their safety but also for the well-being of homeowners and their pets.
According to data from The American Veterinary Medical Association (AVMA), approximately 4.5 million people are bitten by dogs each year in the United States alone. Many of these incidents occur on private property and could be prevented with better adherence to policies regarding entry points during law enforcement visits.
We call upon Culpeper County's law enforcement agencies and local government officials to enforce strict adherence among all officers regarding this policy: use only front doors when delivering civil papers unless otherwise necessary or explicitly permitted by homeowners.
By doing so, we can prevent unnecessary accidents that lead our beloved pets being wrongfully deemed dangerous or vicious due solely to unexpected encounters with law enforcement personnel entering through non-public access points at homes.
