The Issue
WHY THIS PETITION MATTERS PETITION ORIGINATION DATE: OCTOBER 21, 2022
Cottonfields Community Association is facing a challenge and we need your help immediately. Cottonfields Community Association is a subdivision located in Laveen, Arizona. Cottonfields Community shares common land and rules with Southern Ridge Golf Course. One of the rules is that the surrounding land owned by the golf course be protected from commercial/residential development.
Current zoning requirements for the golf course land is stay a golf course or an irrigated green space/park. If residential or commercial development is considered it is a change that is suppose to require majority HOA member's approval according to the community Covenants, Conditions and Restrictions (CC&R's) It has been said an old Cottonfield Community Association H.O.A. board illegally changed the rules back in 2010, without a community vote.
Since then, different board members and homeowners have gone back and forth over the issue, with one board filing for the protections and another voting to remove them. The potential problem homeowner's have is we don't need a two-thirds vote of the majority. We just need 3 board members to do this. The HOA filed suit asking a Judge to decide. Homeowner's began to lose trust in the H.O.A. board members thinking the board will settle with golf course ownership and commercial/residential building will follow.
Homeowner's began to take action by petition to recall board members, and that's when things got ugly. They accused some board members and supporters of harrassment while they tried collecting signatures. This is why we have formed this online petition to bypass face to face confrontation.
We are asking you as a Cottonfields Community Association homeowner for your signature today. If New Golf Course Ownership is not planning to reopen the golf course then WE/Homeowners must come together to figure out the community’s plan moving forward. If the current golf course ownership do not reopen the golf course then let’s work together to figure out what can be done. The golf course land continues to be neglected. For nearly 5 years the golf course has been closed and neglected. We need change and this is why we chose this platform to be heard.
We are asking for all Cottonfields Community Association homeowner's who are in agreement with this petition to sign the petition today. We appreciate your help, concern and participation regarding this matter. We must work together and make sure we are taken seriously. ABC News Channel 15 reported on this problem in 2018. Why this Petition? What value does this Petition bring to the Cottonfields Community Homeowners? What solutions does this Petition offer? All valid questions and talking points. This Petition offers an open forum for you to share your input, your thoughts, your feelings and any ideas you may have to fix this problem. Too many times in Cottonfields Community H.O.A. Board meetings people are talking over each other, can’t hear people speaking clearly half the time because the meetings are still “Virtual Meetings” not in person, face to face.
This Petition offers you the ability to speak through your writing very clearly without any interruptions. Lastly, what solutions does this online Petition offer? We don’t claim to have all the answers right now. We are continuing to collect information and consulting with Cottonfields Community Homeowners to discuss what options are available so we can move forward in the direction we see best for Cottonfields Community Homeowners.
Right now we do know developing a master planned community on the entire golf course land we are not in agreement with current golf course ownership.
