We are tired of rising HOA fees but not seeing where the money is going. Our current three member board of directors are non-existent. We have Laura that lives in the community, James who doesn’t live in the community, and Alex that sold his unit on July 16, 2021. That’s not right! There have been two HOA increases within the last year. As of July 2022 the HOA is operating with a net loss of almost $2 million dollars. Where is the money going?
The pool has been closed all of 2022 for construction after a budget increase for it. Yet we are paying $500 a month for janitorial services for cleaning the lounging area along with the playground? Are we cleaning behind the construction crew? That’s not our responsibility. What is being cleaned at the playground? There isn’t a trash receptacle there and the pandemic is OVER.
A new landscaping company was hired to maintain the property. They were paid more to do less due to the construction. However, there have been months where some units were not cut, edge, nor hedges trimmed back. This is unsafe considering there are retention ponds throughout the community with snakes while kids are playing.
The roofs on our buildings are original. Only the lower roofs are being replaced for the construction defect. Some owners are having a hard time obtaining or being dropped by their insurance company due to the age of the roof. The HOA says the roof is not their responsibility but according to HOA documents it is.
In October 2022 there were Stop Work orders placed on multiple buildings in phase 2 by the city. After research by non-board members we learned that this was due to permits not being filed with the city. During this discovery we also learned that buildings that were deemed complete didn’t have permits filed with the city also. How could they let this happen for so long? Construction began in October 2021 with an estimated completion date of July 2022. There are still well over a bakers dozen of buildings left to be completed. We have weathered 2 hurricanes, multiple thunderstorms, ungodly high temperatures, and now the cold without proper insulation due to only having Tyvek, plastic, and incomplete vinyl sliding on our buildings for 6 months or better. Most neighbors were not able to enjoy their patio this summer because their door is covered with Tyvek or plastic. FYI, they are still covered. We are unable to cover our windows properly due to work on the inside has not been completed. As of December 18 full construction still hasn’t resumed. This is utterly disappointing all while our board members are mute and we are scrambling for answers.
Therefore, the undersigned members hereby petition the board of directors to set the earliest reasonable date, time and place for a special membership meeting for the purpose of discussing construction with Empire Works and/or voting for new board members removing Laura Miller, James DeLong, and replacing Alex Dominicci due to selling his property on July 16, 2021 and that notice and/or ballots be sent to the membership in accordance with Florida law and/or Biscayne Bay Homeowners Association rules and bylaws.
82 owners are needed to bring a change but the more the merrier.
